Palmerston, Port Chalmers, Dunedin, Balclutha,

A PROCLAMATION.
WHEREAS by the fifty-fourth section of "The
Mines Act, 1877," it is, amongst other things,
enacted that it shall be lawful for the Governor to
cause Crown lands situate within a gold field to be
selected and set apart for the purpose of granting
agricultural leases thereon and therefor; or for
alienation by occupation licenses on deferred pay-
ments under any law for the time being in force in
the land district in which such mining district is
situate:
And whereas the lands described in the Schedule
hereto are Crown lands subject to be dealt with
under the provisions of the said Act, and it is
deemed expedient to set the same apart to be dealt
with under the said Act, for alienation by occupa-
tion licenses on deferred payments as aforesaid:
Now, therefore, I, George Augustus Constantine,
Marquis of Normanby, Governor of the Colony of
New Zealand, do hereby set apart, for the purpose
of alienation by occupation licenses on deferred
payments, the lands described in the Schedule hereto;
and do fix the second day of September next
ensuing as the day on which the said allotments
shall be open for application in allotments, as sur-
veyed and marked on the survey map in the office of
the Chief Surveyor, Dunedin.

Given under the hand of His Excellency the
Most Honorable George Augustus Con-
stantine, Marquis of Normanby, Earl of
Mulgrave, Viscount Normanby, and Baron
Mulgrave of Mulgrave, all in the County
of York, in the Peerage of the United
Kingdom; and Baron Mulgrave of New
Ross, in the County of Wexford, in the
Peerage of Ireland; a Member of Her
Majesty's Most Honorable Privy Coun-
cil; Knight Grand Cross of the Most
Distinguished Order of Saint Michael
and Saint George; Governor and Com-
mander-in-Chief in and over Her Majesty's
WHEREAS by the one hundred and twenty-
second section of "The Public Works Act,
1876," it is enacted that every railway shall be made
only under the authority of a special Act, which
shall state as nearly as may be the line of the railway
and the two termini thereof; and by the one hundred
and twenty-third section of the same Act, that the
several railways specified in the Fourth Schedule to
the said Act shall be deemed to have been made, and
in so far as any of them are unfinished may be com-
pleted, under the provisions of the Act now under
recital, and the said Act shall be deemed to be a
special Act authorizing the construction of each of
the said railways; and by the one hundred and
twenty-fourth section of the same Act, that when any
railway is to be constructed under the provisions of
any special Act the Governor shall issue a Proclama-
tion defining the middle line of the railway or any
part thereof, and may from time to time, by a Pro-
clamation revoking or amending such former Pro-
clamation, alter such line in any manner or to any
extent which may be found necessary for the con-
struction of such railway within the provisions of the
said special Act; and by the one hundred and
twenty-fifth section of the same Act, that the
Minister shall cause to be made and deposited in the
office of the Registrar of the Supreme Court. such
maps and plans as may be necessary to explain the
said line and the land through which the same passes,
and such maps and plans shall be referred to in any
such Proclamation; and whereas the railway from
Amberley to the Bluff, passing by Rangiora, Kaiapoi,
Christchurch, Ashburton, Timaru, Oamaru, Palmer-
ston, Port Chalmers, Dunedin, Balclutha, and Inver-
cargill, is one of the railways specified in the said
Fourth Schedule, and the same is unfinished, and it
has been determined to construct and maintain a
further portion of such railway:
Now, therefore, I, George Augustus Constantine,
Marquis of Normanby, the Governor of the Colony
of New Zealand, in exercise and pursuance of the
powers and authorities conferred on me by "The
Public Works Act, 1876," and in exercise of every
other power and authority enabling me in that be-
half, do hereby proclaim and declare that the middle
line of the said further portion of said railway shall
be that defined and set forth in the Schedule hereto,
and that the two termini of the said line shall be
a point in Rural Section number one hundred
and thirteen (113), and a point in Rural Section
number nine (9), Christchurch District, Provincial
District of Canterbury. The said middle line, and
the land through which the same passes, are set forth
in the map and plan marked P.W.D. 6523, and
authenticated for the purposes of this Proclamation
by the signature of the Honorable James Temple
