  1. These regulations shall apply to every Educa-
    tion Board constituted prior to or after the coming
    into operation of "The Education Act, 1877," and
    shall come into force upon the thirteenth day of
    March instant.

Making Regulations for granting Agricultural Leases
within the Ohinemuri Block, Hauraki Gold-Mining
District.

NORMANBY, Governor.

IN pursuance of the powers vested in me by "The
Gold Mining Districts Act, 1873," and "The
Ohinemuri Gold Field Agricultural Leases Validation
Act, 1876," and of every other power and authority
enabling me in this behalf, I, George Augustus Con-
stantine, Marquis of Normanby, the Governor of
the Colony of New Zealand, do hereby make the
following Regulations for the Ohinemuri Gold Field,
Hauraki Gold-Mining District, prescribing the mode
in which applications may be made for leases of land
for agricultural purposes; the quantity of land, not
exceeding two hundred acres, which shall and may be
granted in a lease in any particular block; the amount
of deposits to be paid by any applicant therefor, and
by any objector thereto; the terms and conditions
upon which such leases may be held, occupied,
assigned, transferred, forfeited, and cancelled; the
amount of rent payable therefor, and the times and
places of payment; the conditions upon which and
the manner in which entry to search for gold, or for
any metal or mineral, upon any land so leased may
be authorized; and the terms and conditions upon
which the holders of miners' rights may be permitted
to mine upon land the lease for which shall have been
determined on account of its auriferous character.

Mulgrave, Viscount Normanby, and Baron
Mulgrave of Mulgrave, all in the County
of York, in the Peerage of the United
Kingdom; and Baron Mulgrave of New
Ross, in the County of Wexford, in the
Peerage of Ireland; a Member of Her
Majesty's Most Honorable Privy Coun-
cil; Knight Grand Cross of the Most
Distinguished Order of Saint Michael and
Saint George; Governor and Commander-
in-Chief in and over Her Majesty's Colony
of New Zealand and its Dependencies,
and Vice-Admiral of the same; at the
Government House, at Auckland, this
thirteenth day of March, in the year
of our Lord one thousand eight hundred
and seventy-eight.

LEASES.

REGULATIONS FOR GRANTING AGRICULTURAL LEASES
WITHIN THE OHINEMURI BLOCK, HAURAKI GOLD-
MINING DISTRICT.

Applications.

  1. All applications for leases shall be accompanied
    by a sketch plan of the land applied for, which shall,
    so far as practicable, exhibit to the satisfaction of the
    Warden the boundaries and estimated acreage of the
    land for which a lease is asked.

Deposit to be made.

  1. Before lodging his application, the applicant
    shall deposit five pounds with the Receiver of Gold
    Revenue, who shall give a receipt therefor in dupli-
    cate, and no application shall be entertained unless
    one duplicate be annexed to the application. In the
    event of the lease issuing, the sum deposited shall
    be placed to the credit of the applicant, towards
    payment of the first year's rent and the cost of pre-
    paring the lease; in the event of the lease being
    refused, the same shall be returned to the applicant.

Applications to be recorded.

  1. Every application shall be recorded in a book to
    be kept for the purpose, and the date and hour of
    the receipt of such application, the name of the appli-
    cant, and the area and situation of the land applied
    for, shall be minuted therein, together with the
    address to be given by the applicant for service.
    Such book shall be open to public inspection, and
    any person may take a copy of any minute therein.

Term and Area.

  1. No application shall be received for a lease of
    less than ten acres or more than fifty acres, and no
    lease shall be granted for a longer term than twenty-
    one years, and it shall not be competent for any
    person to hold two or more distinct selections of any
    land dealt with under these Regulations. Any lessee
    may, with the consent of the Warden, hold by
    transfer an area not exceeding two hundred acres:
    Provided the selections adjoin and the conditions of
    each lease have been complied with.

  1. Every area of land applied for must, so far as
    the features of the country will permit, be of a
    rectangular form, and, when fronting on a road, river,
    lake, or coast, where practicable, must be of a depth
    not less than twice its length of frontage. No such
    selection must be made so as to monopolize the wood
    or water, or any landing-place, in any locality. No
    lease shall be granted on any selection made in such
    a manner as to injuriously interfere with the disposi-
    tion of the remainder of any land in the vicinity of
    the land so selected.

Applicant to survey.

  1. Each applicant shall have the land selected by
    him surveyed at his own expense by a surveyor duly
    authorized by the Chief Surveyor of the Auckland
    District, and shall cause to be delivered, at the Survey
    Office, Auckland, a plan and tracing of the same,
    executed in accordance with the instructions of the
    Surveyor-General, within six months of the date of
    application, and the Chief Surveyor shall, if the plan
    be so executed, certify the same upon the tracing,
    and transmit it to the Warden's office.

How Lease to be executed.

  1. As soon as conveniently may be after the deposit
    of the survey plan as aforesaid, a lease in due form,
    executed on behalf of Her Majesty, will be issued to
    the applicant upon his executing a counterpart
    thereof, and paying for such lease the sum of thirty
    shillings.

Lease to be forfeited if not executed within One
Month.

  1. Any applicant who shall fail to execute the
    counterpart of his lease for the space of one calendar
    month after notice shall have been given that the
    same is ready for signature shall forfeit his right to
    such lease. Any such notice may be delivered per-
    sonally, or sent by post addressed to the place of
    abode of the applicant.

Rent to be paid in Advance.

  1. The rent per acre to be reserved upon every
    lease shall be at the annual rate of one shilling for
    the first seven years, one shilling and sixpence for
    the second seven years, and two shillings for the last
