Changing the Purpose of a Reserve.

ORDER IN COUNCIL.

At the Government House, at Wellington, this
twenty-fourth day of December, 1878.
Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the land mentioned in the first column
of the Schedule hereto was granted to the
Superintendent of the Province of Canterbury, on
the thirtieth day of September, one thousand eight
hundred and sixty-eight, for a ferry reserve :

And whereas the said reserve is for one of the pur-
poses named in Part I. of "The Public Reserves Act
Amendment Act, 1878," and, in the opinion of the
Governor, it is expedient to change the purposes of
such reserve to another of the purposes named in the
said Part I. as hereinafter mentioned:

Now, therefore, the Governor of the Colony of
New Zealand, by and with the advice and consent of
the Executive Council of the said colony, and in
exercise of the powers and authorities vested in him
by the sixth section of "The Public Reserves Act
Amendment Act, 1878," doth hereby order and direct
that the purpose of the reserve mentioned in the
first column of the said Schedule hereto shall be
changed from that of a reserve for a ferry, and doth
hereby declare and define the purposes of the said
reserve to be those specified in the second column of
the said Schedule, the same being one of the pur-
poses named in Part I. of the said Act.

Notification of the Consent of Ratepayers and Owners
to the Construction of the Duntroon-Hakateramea
Railway.

NORMANBY, Governor.

IN terms of the regulations made under "The Dis-
trict Railways Act, 1877," and published in
the New Zealand Gazette of the eleventh day of
July, one thousand eight hundred and seventy-eight,
I, George Augustus Constantine, Marquis of Nor-
manby, the Governor of the Colony of New Zealand,
do hereby notify and declare that the consent of
the ratepayers and owners of property within the
railway district proposed to be constituted for the
purpose of the railway proposed to be constructed by
the Duntroon and Hakateramea Railway Company
(Limited), under the provisions of the above-men-
tioned Act, from Duntroon, in the Provincial District

Assent to Construction of Duntroon and Hakatera-
mea Railway from Marewhenua River Northwards,
and Area and Boundaries of Railway District.

NORMANBY, Governor.

WHEREAS by sections eighteen and nineteen of
"The District Railways Act, 1877" (herein
referred to as "the said Act"), it is enacted that
whenever the Governor shall approve of or object to
any proposed railway, he shall, by notice gazetted,
declare his assent to or disapproval of the construc-
tion of the railway, and such notice when so pub-
lished shall be sufficient notice to the company of
such approval or dissent, as the case may be; and
that in and by any notice of approval the Governor
shall declare the area and boundaries proposed to be
a railway district for the purposes of the said Act,
and such declaration shall be sufficient evidence of
the constitution of such district for the purposes of
the said Act:

And whereas the Duntroon and Hakateramea
Railway Company (Limited) propose to construct a
railway under the said Act, and a majority of the
whole body of ratepayers and owners of property in
the proposed district, representing more than one-
half of the value of the rateable property, have con-
sented to the construction of the proposed railway:

And whereas the said Company have made applica-
tion to me for my approval of the construction of
the said railway, and all things have been done and
performed as required by the said Act to obtain such
approval:

Now, therefore, I George Augustus Constantine,
Marquis of Normanby, the Governor of the Colony
of New Zealand, in exercise and pursuance of the
powers vested in me by the said Act, do hereby
notify and declare that I do hereby assent to the
construction of the Duntroon to Hakateramea Rail-
way from Marewhenua River northwards, as shown
on the plan and in the book of reference, with the
exception of the lands described therein as num-
bered on plan from one to six inclusive; and I further
notify and declare that the area and boundaries of
the district for the purposes of the said railway are
as follows:-

All the lands within the following boundaries,
comprising an estimated area of 140,000 acres-viz.,
commencing at a point formed by the junction of the
Marewhenua River with the Waitaki River, along the
western bank of the Marewhenua River to a point
formed by its intersection with the western boundary
of Section 19, Block VII., Marewhenua Survey Dis-
trict; thence in a north-westerly direction in a direct
line to the north-west corner of Section 1, Block
XIII., Marewhenua District; thence in a northern
direction to a point on the boundary between Runs
Nos. 23 and 28, about 100 chains distant from its
junction with the Waitaki River; thence in a north-
westerly direction to a point on the Waitaki River
above the Kurow Ferry, and 80 chains distant there-
from; thence in a straight line to a point formed by
the junction of the north-western boundary of Sec-
tion No. 29561 with the Waitaki River, in the Pro-
vincial District
