Making Regulations under "The Land-Tax Act,
1878."

NORMANBY, Governor.
ORDER IN COUNCIL.

At the Government House, at Wellington, this
twenty-sixth day of November, 1878.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

W HEREAS by the seventeenth section of "The
Land-Tax Act, 1878," it is enacted, among
other things, that the Governor, by Order in Council,
may from time to time make, alter, and revoke regu-
lations not inconsistent with the said Act, and shall
fix a day when the same shall come into operation
and have the force of law:

And whereas it is expedient to make certain regu-
lations applicable to the purposes of the said Act,
and to fix a day when the same shall come into
operation:

Now, therefore, I, George Augustus Constantine,
Marquis of Normanby, the Governor of the Colony
of New Zealand, by and with the advice and consent
of the Executive Council of the said colony, do hereby
make the following regulations for the purposes of
the said Act, as set forth in the Schedule hereto:

And, with the like advice and consent, do hereby
order and declare that the said regulations shall
come into operation on the first day of January, one
thousand eight hundred and seventy-nine.

SCHEDULE.

THE Commissioner appointed under "The Land-Tax
Act, 1878," shall have full control over and give
directions, not inconsistent with the said Act, to all
Deputy Commissioners, Valuers, Collectors and other
officers engaged or employed in the administration
of the Act, and shall do and perform all the duties
pertaining to the office of Commissioner, as specified
therein.

  1. All Deputy Commissioners, Valuers, Collectors,
    and other officers engaged or employed in the admin-
    istration of said Act shall receive their instructions
    from, and be responsible to, the Commissioner for
    the due performance of their duties; and the Com-
    missioner may, from time to time and at any time,
    examine into the manner in which any officer has
    performed his duties, and for that purpose may
    require the production of all books, papers, or docu-
    ments for examination, and take such evidence as he
    may think necessary or requisite, and may report the
    result to the Minister of the department, who, if he
    see cause, may submit the same to be dealt with by
    the Governor in Council.

  2. It shall be the duty of every Valuer to obtain,
    if possible, personally, or by letter, from every owner
    of land within his district who is deemed to be an
    owner under the fifth section and its subdivisions, as
    well as the sixth section of the said Act, a statement
    in writing, on a prescribed form for the purpose, with
    the signature of such owner attached thereto, of
    the quantity and nature of the lands and tenements
    owned or occupied by such person, and the estimated
    value thereof to sell, and also the extent, nature,
    and value respectively of the different improvements
    thereon in the meaning assigned to the same under
    the second or interpretation clause of the said Act.

In all cases where such return relating to any
property cannot be obtained personally, the Valuer
will, after due inquiry, fill up the particulars to the
best of his knowledge and belief, and enter the same
in his valuation list, as prescribed by the twentieth
clause of the Act.

If, in the performance of his duty, any Valuer is
obstructed, or has been refused, or not put into
possession of any information necessary to the due
performance of his duties, or has received any false
or evasive answer, it will be his duty to sue for the
penalty provided by the twenty-second clause of the
Act, and shall immediately report every such case
to the Deputy Commissioner, who shall transmit the
same to the Commissioner.

  1. When the valuation lists are completed and
    received by the Deputy Commissioner, he shall cause
    the same to be deposited in some public place for
    fourteen days, of which due notice must be given as
    provided by the Act.

  2. It shall be the duty of every Collector or
    Receiver to collect the tax in the manner which
    shall be prescribed by the Commissioner, and to
    make the necessary returns of same on a prescribed
    form, in accordance with the Treasury regulations.

  3. Every District Land Registrar and Registrar of
    Deeds in each district shall, during the first week in
    each month, deliver or cause to be delivered to the
    Deputy Commissioner of the district in which the
    land affected may be situated, a return of all lands
    of which he may be informed that any change in the
    ownership has taken place; such return to be on a
    prescribed form, and to embrace the fullest par-
    ticulars as may be required to make the necessary
    additions to, or alterations in, the Land-Tax Register.

  4. Every Commissioner of Crown Lands in each
    district shall, during the first week in each month,
    deliver or cause to be delivered to the Deputy Com-
    missioner of the district in which the land affected
    may be situated, a return of all Crown lands, in-
    cluding any within a gold fields district, which may
    be sold or otherwise alienated during the previous
    month; such return to be on a prescribed form, and
    to embrace the fullest particulars as may be required
    to make the necessary additions to, or alterations in,
    the Land-Tax Register.

  5. Every Warden's Clerk shall, during the first
    week in each month, deliver or cause to be delivered
    to the Deputy Commissioner of the district in which
    the land affected may be situated, a return of all
    leases or licenses granted or transferred under "The
