Member of Her Majesty's Most Honor-
able Privy Council; Knight Grand Cross
of the Most Distinguished Order of Saint
Michael and Saint George; Governor
and Commander-in-Chief in and over Her
Majesty's Colony of New Zealand and its
Dependencies, and Vice-Admiral of the
same; and issued under the Seal of the
said Colony, at the Government House,
at Wellington, this fifth day of
February, in the year of our Lord one

New Zealand Railways.--By-law in substitution of
By-law 21, fixed by Order in Council of 17th April,
1877.

ORDER IN COUNCIL.

At the Government House, at Wellington, this
fifth day of February, 1878.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance of the power and authority vested in
him by the one hundred and forty-fifth section
of "The Public Works Act, 1876," and of all other
powers and authorities in any wise enabling him,
His Excellency the Governor of the Colony of New
Zealand, by and with the advice and consent of the
Executive Council thereof, doth hereby cancel By-
law 21, fixed by Order in Council of 17th April,
1877, and in substitution thereof doth make the
following, and doth declare that the same shall come
into force on the several lines of railway in New
Zealand from the day of the date hereof :-

  1. Smoking is strictly prohibited in any of the
    railway sheds, offices, platforms, waiting-rooms, or
    any portion of the railway premises; and any person
    so smoking shall be liable to a penalty not exceeding
    ten pounds.

Extending Time for receiving Valuation List, Tutu-
rau Road District.

NORMANBY, Governor.
ORDER IN COUNCIL.

At the Government House, at Wellington, this
fifth day of February, 1878.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by "The Rating Act, 1876," it is
enacted that if the local body or the Assess-
ment Court fails through misadventure or accident
to do anything which by that Act is required to
be done in a fixed time, the Governor may, by an
Order in Council, published in the Government
Gazette, and publicly notified, extend the time for
doing such thing, and may by any such order validate
anything which may have been irregularly done in
matter of form, so that the intent and purpose of the
said Act may have effect: And whereas the Valuer
of the Tuturau Road Board, being the local body of
the Tuturau Road District constituted under an
Ordinance of the Province of Otago, intituled "The
Roads Ordinance, 1871," has failed by misadventure
to transmit the valuation list within the time specified
by the said Rating Act, 1876:

Now, therefore, I, George Augustus Constantine,
Marquis of Normanby, the Governor of the Colony
of New Zealand, in exercise of the powers and autho-
rities vested in me by "The Rating Act, 1876," and
of every other power and authority enabling me in
that behalf, do hereby, by and with the advice and
consent of the Executive Council of the said colony,
extend the time for the transmission of the valuation
list for the said district, until not later than the
ninth day of February, one thousand eight hundred
and seventy-eight; and with the like advice and
consent do hereby order that such valuation list shall
be deposited, lie open for inspection, public notice be
given, ratepayers and others may inspect such valua-
tion list and take copies thereof and make objections
thereto, as provided by the said Act, from the ninth
day of February, one thousand eight hundred and
seventy-eight, to the twenty-eighth day of February,
one thousand eight hundred and seventy-eight; and
I do hereby, with the like advice and consent, extend
the time accordingly.

Delegation of Powers under "The Mines Act, 1877."

(L.S.) NORMANBY, Governor.

WHEREAS by the one hundredth section of
"The Mines Act, 1877," the Governor is em-
powered to delegate to the Chairman of the County
Council of any county in any mining district all the
powers vested in the Governor by subsections four
and five of section fifty-one of that Act:

Now, therefore, I, George Augustus Constantine,
Marquis of Normanby, the Governor of the Colony
of New Zealand, do hereby, in exercise of the powers
vested in me by the said Act, delegate unto the
Chairman for the time being of the County Council
of Vincent, all the powers vested in the Governor by
section fifty-one of "The Mines Act, 1877," of making,
altering, amending, and revoking rules and regula-
tions for the purposes contained in subsections four
and five of the said section fifty-one: And I do
hereby declare that the powers hereby delegated
shall be exercised and performed only within the
said County of Vincent, and by and with the consent
of the County Council of the said County of Vincent.
