and equipment thereof.

Between ROBERT HEATON RHODES and WILLIAM
DONALD, Trustees of the real estate of GEORGE
RHODES, deceased, and the said Robert Heaton
Rhodes, plaintiffs, and THOMAS WADSWORTH,
defendant.

NOTICE is hereby given that, under a writ of
fieri facias, duly issued herein out of the
Supreme Court of New Zealand, Canterbury Dis-
trict, against the real and personal estate of the
above-named defendant at the suit of the above-
named plaintiffs, I have seized and taken into execu-
tion all the estate and interest of the above-named
defendant (comprising his estate in fee-simple in
possession, free from all encumbrances) in all that
piece or parcel of land containing by admeasurement
thirty acres, or thereabouts, situate in the County of
Geraldine, in the Provincial District of Canterbury,
New Zealand, and being the Rural Section numbered
4407 on the map or plan of the Chief Surveyor of
the late Province of Canterbury, now the said pro-
vincial district, setting out and describing the rural
lands in the Timaru District thereof, together with
the hotel known as the "Orari Hotel," and the other
buildings and erections thereon; and that I intend
to cause the same to be sold by public auction, at
the auction-rooms of Messrs. John King and Co., in
the Borough of Timaru, on the thirtieth (30th) day
of December, 1878, at the hour of eleven o'clock in
the forenoon, unless the judgment-debt and the costs
and expenses of and incidental to this execution be
previously paid and satisfied.

The Solicitor for the Execution Creditors is Arthur
Perry, Esq., of the Main South Road, in the said
Borough of Timaru.

HEREBY give notice that, under a writ of fieri
I facias, duly issued out of the Supreme Court, at
the suit of WILLIAM WADDELL, ARCHIBALD MCLEOD,
and WILLIAM WEIR, all of the City of Wellington,
Timber Merchants, I have taken in execution the
equity of redemption of JOHN BREEN in all that
piece or parcel of land being part of Section 71, on
the plan of the City of Wellington, having a front-
age on the East to Hopper Street of thirty-three
feet by a depth of seventy feet, the southern boun-
dary being distant seventy-six feet from the northern
boundary of Section 70. And that I intend to cause
the same to be sold by public auction, at the rooms
of Messrs. Laery and Campbell, in the City of Wel-
lington, on the sixth day of January, 1879, at two
o'clock n the afternoon.

HEREBY give notice that, under a writ of fieri
I facias, duly issued out of the Supreme Court,
the suit of OLIVER WITTON CLAYTON, of the City of
Wellington, I have taken in execution the equity of
redemption of EDWARD SHEEHAN, of the City of
Wellington, Carter, in all that piece of land being
Lot numbered 1 of Section 373, on the plan of the
City of Wellington. Bounded towards the South-
east by Macfarlane Street, sixty-four (64) links;
towards the North-east by other part of the same
Section, one hundred and twenty-nine (129) links;
towards the North-west by Clyde Quay, seventy (70)
links; and towards the South-west by other part of
the said section, one hundred and sixty-six (166)
links: together with the erections and buildings
thereon. And that I intend to cause the same to be
sold at the auction-rooms of Messrs. Laery and
Campbell, in the City of Wellington, on the twenty-
second day of November, 1878, at two o'clock in the
afternoon, unless the same be previously released.

NOTICE OF INTENTION TO CONSTRUCT A WATER-
RACE.

Tuapeka, 15th October, 1878.
To the Warden at Lawrence.

WE hereby give notice that we intend to apply
to construct a Water-race to divert and use
water for mining purposes, commencing at a point
in the second north-western branch of Gabriel's
Gully, 400 yards below the present lifting point of
Water-race Certificate No. 467, and terminating at
No. 1 Mining Lease Claim Battery, Blue Spur.

The length of such race is four miles or thereabout;
and its intended course is south, running between
the Hibernian and Otago Company's Water-races.
The mean depth of such race is 2 feet, and the
mean breadth is 2 feet 6 inches; and it is pro-
posed to divert five Government-heads of water.

And we hereby give notice that we intend to apply
to construct a dam-bank and form a reservoir for
the storage of water in the first north-western branch
of Gabriel's Gully, and that the following are the
particulars respecting such dam and reservoir :-
(1.) Locality: About 300 yards below the Hiber-
nian Reservoir. (2.) Length of dam: 210 feet. (3.)
Greatest height: 60 feet. (4.) Greatest breadth of
base: 120 feet. (5.) Area of reservoir: 260 yards by
70 yards. Time estimated for construction, six
months.
