Delegation of Governor's Powers under "The Public
Domains Act, 1860."

ORDER IN COUNCIL.
At the Government House, at Wellington, this
twenty-third day of October, 1877.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by the eleventh section of "The
Public Domains Act, 1860," it is enacted that
the Governor may from time to time, by Order in
Council, delegate all or any of the powers thereby
conferred upon him to any person for any period, and
subject to such stipulations as may be specified in such
order, and that every such delegation may from time
to time in like manner be altered or revoked: And
whereas it is enacted by "The Public Domains Act
Amendment Act, 1865," that the word "person" in
the said eleventh section of the said Act shall be
deemed to include more persons than one: And
whereas by the second section of "The Auckland
Military Reserves Act, 1871," it is declared that all
the land mentioned or described in the First Schedule
to the said Act is subject to the provisions of "The
Public Domains Act, 1860," and "The Public
Domains Act Amendment Act, 1865:"
Now, therefore, His Excellency the Governor, by
and with the advice and consent of the Executive
Council, doth by this present order revoke the dele-

| respect of lands contained in the Schedules to the
| last said Act, and "The Auckland Military Reserves
| Act, 1871," respectively, all the powers conferred by
| the said Act, except the powers under subsections
| two, five, and ten of section five, and under section
| eleven, to the under-mentioned persons :--
Francis Dart Fenton, Esquire;
Theophilus Heale, Esquire;
George Manners Mitford, Esquire;
George Burgoyne Owen, Esquire;
His Worship the Mayor of the City of Auck-
land;
His Worship the Mayor of the Borough of
Parnell;
The Chairman of the Highway District Board,
Newmarket;
The Chairman of the Highway District Board,
Newton;
The Chairman of the Highway District Board,
Ponsonby and or Dedwood;
The Chairman of the Highway District Board,
Grafton Road;
The Chairman of the Highway District Board,
Karangahape Road;
subject to the stipulations hereinafter contained :--

None of the powers delegated shall be exercised
in respect of any land in the actual occupation of
the Governor, except at his instance or request, nor
in respect of any buildings situate on the land
described in the First Schedule to "The Auckland
Military Reserves Act, 1871," except at the instance
and request of the Colonial Government; and in
respect of any land mentioned in section three of
the Schedule to "The Public Domains Act, 1860,"
and in the Schedule to "The Public Domains Acts
Extension Act, 1868." -
The Board shall meet at such times and places
as shall be from time to time appointed by the Chair-
man, or shall be convened by him. -
The Board shall keep proper minutes and re-
cords of its proceedings, and separate minutes and
accounts shall be kept in respect of the lands
described in the First Schedule to "The Auckland
Military Reserves Act, 1871." Yearly reports shall
be sent to the Colonial Government. -
Three members of the Board shall form a
quorum. -
All questions shall be determined by a majority
of the members of the Board present at a meeting.
The Chairman shall have a casting as well as an
original vote.

BY virtue of the powers and authorities vested in
me by "The Diseased Cattle Act, 1871," and of
every other power and authority in that behalf me
enabling, I, George Augustus Constantine, Marquis
of Normanby, the Governor of the Colony of New
Zealand, by and with the advice and consent of the
Executive Council of the said colony, do hereby
annul a certain Proclamation proclaiming the District
of Kaikoura to be an infected district under "The
