THE NEW ZEALAND GAZETTE.

"THAT the charges of this inquiry resolve themselves
into four, viz,–
"1. Steaming round the 'Napier.'
"2. Taking the bar of the Manuwatu before the
signal 'Take the bar' was hoisted.
"3. Collision with the 'Napier' in the Manawatu
River.
"4. Drunkenness.
"The Court holds that the charge of drunkenness
and consequent incapacity to perform his duty by
the Master on the night of May the 5th is not
proved; that the steaming round the 'Napier,' on
the same night, was an eccentric action, and not that
of a careful and prudent man, although it seems
doubtful whether the two ships came so close to
each other as to endanger or risk life or property;
that taking the Manawatu Bar with the signal flying
'Wait for tide,' was another reprehensible act, and
might have led to great danger.
"That the collision in the River Manawatu was
solely caused by the 'Tui' steaming at full speed,
overtaking the 'Napier,' and endeavouring to pass
that vessel, on her wrong side, in the narrowest part
of the channel, while the 'Napier,' on her part, was
steering her proper course.
"There is thus a sequence of events from the night
of May the 5th to the afternoon of May the 6th any
one of which might have resulted in serious con-
sequences, and one of them causing considerable
damage, showing culpable recklessness in the man-
agement of the 'Tui.'
"The Master, Charles Bonner, is therefore adjudged
guilty of gross misconduct, accompanied by serious
damage to property, and is sentenced to suspension
of his certificate for a period of six calendar months,
and ordered to pay costs.
"Given under my hand, this sixteenth day of
June, one thousand eight hundred and
seventy-seven, at Wellington, in the
Colony of New Zealand.

OPINION OF NAUTICAL ASSESSOR.

I, Robert Johnson, Nautical Assessor on the enquiry
into the conduct of Charles Bonner, concur in the
above report concerning the conduct of the said
Charles Bonner.

Alterations in the Rates for the Conveyance and
Delivery of Goods on all the New Zealand Rail-
ways published in the New Zealand Gazette, No.
48, of the 1st of June, 1877.

IN accordance with the By-laws for the New
Zealand Railways, fixed by Order in Council
dated the 17th day of April, 1877, the following
alterations in the rates for the conveyance and
delivery of goods on all the New Zealand Railways
published in the New Zealand Gazette, No. 48, of
the 1st of June, 1877, are hereby declared to be
fixed, and shall come into force from the day of the
date hereof:---
The minimum quantities of goods of Classes A, B,
C, D charged for to be 2 cwt.
Class E, in quantities of less than 2 tons, to be
carried as Class D.
Class F, in lots of less than 2 tons, if in bags or
packages, to be carried as Class D.
When a consignor sends to the same consignee
several packages of different classes which may each
be below the minimum quantity of 2 cwt., the whole
may be sent as one consignment, carried at the rate

for that class of goods to which the heaviest package
belongs.

Alteration in Rate for use of the Mount Ida Water-
race in substitution of Rate in 5th Regulation,
published in New Zealand Gazette, No. 53, of the
14th June, 1877.

IN pursuance and exercise of the powers and
authorities vested in me by "The Public Works
Act, 1876," I, the Honorable John Davies Ormond,
Minister for Public Works, do hereby make the
alteration set forth, in the regulations made by me
on the thirteenth day of June, 1877, and published
in the New Zealand Gazette of the fourteenth of June,
1877, prescribing the terms and conditions upon
which the Mount Ida Water-race might be used,
and the rates and charges to be paid for water
supplied.
In the 5th of the said regulations the words and
figures "twenty shillings (20s.)" shall be substituted
for the words and figures "twenty-five shillings
(25s.)"

Given under my hand, at Wellington, this
eighteenth day of July, one thousand
eight hundred and seventy-seven.
