Governor's Assent to Regulations made by the Napier
Harbour Board.
NORMANBY, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this
twenty-fourth day of January, 1877.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
HIS Excellency the Governor of New Zealand, in
pursuance and exercise of all powers and
authorities vested in him by "The Marine Act,
1867," and "The Harbour Boards Act, 1870," or
either of them, doth hereby, with the advice and
consent of the Executive Council of the Colony,
approve of the following Regulations, made by the
Napier Harbour Board:—
REGULATIONS.
THE Napier Harbour Board, by virtue of all powers
in anywise enabling them in that behalf, do hereby
make the following Regulations for the Port of
Napier, and do hereby repeal all former regulations
(or any part or parts thereof) in anywise inconsistent
with the regulations hereby made.
WHARVES.
-
Every master, owner, or agent of a vessel
loading or unloading goods or other cargo at any
wharf, shall, whenever requested by the Wharfinger
of the Board, deliver to him a true return of the
loading of such vessel. -
No master of any vessel shall receive any goods
or other cargo for shipment without the Wharfinger's
receipt for the wharf dues payable in respect of such
goods or cargo having been first delivered to such
master. -
No person shall be allowed to remove any goods
or other cargo from any of the wharves until author-
ized by the Wharfinger. -
No carter or carrier bringing goods or other
cargo for shipment shall be allowed on any wharf
without the production of the Wharfinger's receipt
for the wharf dues payable in respect of such goods
or cargo. -
No driver of any hackney carriage plying for
hire shall be allowed to take such carriage on any
part of any planked jetty. -
Any person committing any breach of the fore-
going Regulations, or any of them, or any part
thereof, shall for each such offence be liable to a
penalty not exceeding £50, to be recovered according
to the provisions of "The Marine Act, 1867."
CARGO BOATS.

If in any case a licensed cargo-boat is not avail-
able for the purpose of discharging or loading any
vessel, as the case may be, then any unlicensed cargo-
boat may be employed for such purpose respectively:
Provided always that the master of any such un-
licensed cargo-boat shall, for every occasion when his
boat shall be employed in the work license fee
ten shillings and sixpence, and threepence per ton
register. -
Any person committing any breach of the last
foregoing regulation shall for each such offence be
liable to a penalty not exceeding £5, to be recovered
according to the provisions of "The Marine Act,
1867."
Passed by the Napier Harbour Board this twelfth
day of December, one thousand eight hundred
and seventy-six.

At the Government House at Wellington, this
thirtieth day of January, 1877.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
IN pursuance of the power and authority vested in
him by the 145th section of "The Public Works
Act, 1876," and of all other powers and authorities
in anywise enabling him, His Excellency the Go-
vernor of the Colony of New Zealand, by and with
the advice and consent of the Executive Council
thereof, doth hereby make the following Rates for
Wharfage on the Railway specified in the Schedule
hereto :-

On all Sailing Vessels, Foreign, Intercolonial,
or Coastwise, from Ports beyond the
limits comprised between Cape Farewell
and Milford Sound, per ton register, per
trip
