NOTE.β€”The term "colonial trading vessel" when used in this Order
in Council shall mean and include any vessel actually trading between New
Zealand and any port within the Australian Colonies, including Tasmania,
or between New Zealand and any of the islands lying between the parallels
of thirty degrees North and thirty degrees of South latitude, and the
meridians of one hundred and fifty-five degrees East and one hundred and
thirty degrees West longitude. (Section 16, "Marine Act Amendment
Act, 1870.")

The term "coasting vessels" and "coasters" shall mean and include
all vessels while employed in trading from any one part of the colony to
any other part thereof.

Governor's Assent to Terms of the Heretaunga Small
Farm Association.

NORMANBY, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this
seventeenth day of October, 1876.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by "The Hawke's Bay Special Settle-
ments Act, 1872," it is, among other things,
enacted that it shall be lawful for the Superintendent
of the Province of Hawke's Bay, with the consent of
the Provincial Council, by Proclamation in the Go-
vernment Gazette of the said province, to set aside
out of the waste lands within the Province of Hawke's
Bay, the Native title to which has been extinguished,
any block or blocks for the purpose of special settle-
ment, not exceeding in the whole thirty thousand
acres, on such terms as may be sanctioned by the
Governor in Council, anything in the existing regu-
lations for the management or disposal of waste lands
in the province to the contrary notwithstanding:

And whereas the said Superintendent, with the
consent of the Provincial Council as aforesaid, hath
proposed to set aside the block of land in the Seventy-
Mile Bush, in the said province, described in the
First Schedule hereto, containing two thousand acres,
more or less, as a special settlement under the said
Act for the members of an Association called the
Heretaunga Small Farm Association, upon the terms
hereinafter mentioned:

And whereas the said Superintendent, with the
consent of the Provincial Council as aforesaid, hath
requested the Governor to sanction the said terms:

Now, therefore, His Excellency the Governor of
the Colony of New Zealand, in pursuance and
exercise of the power and authority vested in him by
the said Act, and by and with the advice and consent
of the Executive Council of the said Colony, doth
hereby sanction the terms set forth in the Second
Schedule hereto as the terms under which the said
proposed special settlement shall be made under the
said Act.

FIRST SCHEDULE.

ALL that parcel of land situate in the Seventy-Mile
Bush, in the Province of Hawke's Bay, being a
portion of the Maharahara Block, and containing by
admeasurement two thousand (2000) acres, more or
