Marquis of Normanby, the Governor of the Colony
of New Zealand, by and with the consent of the
Executive Council of the said Colony, do hereby, in
pursuance and exercise of the power and authority in
me vested in that behalf, revoke so much of the said
Order in Council, of the eighth day of January, one
thousand eight hundred and sixty-eight, as delegated
to the Superintendent of the Province of Hawke's
Bay, and his successors in such office, the powers
therein specified under the seventh section of "The
Marine Act, 1867," and powers under the twelfth,
thirteenth, and forty-second sections of the said Act;
but such revocation shall operate and extend with
respect to the Port of Napier only, as such port
is defined in a Warrant bearing date the twen-
tieth day of November, one thousand eight hundred
and sixty-eight, and published in the New Zealand
Gazette of the twenty-third day of November in the
same year.

Delegating Powers under the 7th and 10th Sections of
"The Marine Act, 1867," to the Napier Harbour
Board.

NORMANBY, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this
nineteenth day of September, 1876.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by the ninth section of "The Harbour
Boards Act, 1870," it is, among other things,
enacted that the Governor may, by Order in Council,
from time to time delegate to any Harbour Board
constituted thereunder all or any of the powers and
authorities vested in him by the provisions contained
in the seventh and tenth sections of "The Marine Act,
1867," subject to any regulations, restrictions, or
stipulations that may be specified in such Order:
And whereas it is expedient that certain powers
should be delegated to the Napier Harbour Board as
in manner hereinafter set forth:

Now, therefore, I, George Augustus Constantine,
Marquis of Normanby, the Governor of the Colony
of New Zealand, by and with the advice and consent
of the Executive Council of the said Colony, in pur-
suance and exercise of the hereinbefore recited power
and authority enabling me in that behalf, do hereby
delegate unto

the several powers and authorities mentioned and set
forth in the Schedule hereto annexed; such powers
and authorities to be exercised within the limits of
the Port of Napier, as therein also mentioned, sub-
ject, however, to such restrictions as in the said
Schedule set forth:

And in further pursuance and exercise of the
hereinbefore in part recited power, and with the like

SUCH of the powers vested in the Governor by the
seventh section of "The Marine Act, 1867," as enable
him to erect, superintend, and maintain harbour
marks, buoys, lights, and beacons within the limits
of the Port of Napier or the approaches thereto;
subject, however, to such directions as may from time
to time be issued by the Commissioner of Customs
as to the size, position, and colour of such harbour
marks, buoys, and beacons, and, in the case of lights,
to the approval first obtained of the said Commissioner
of Customs; and subject also to the condition that no
Notices to Mariners shall be issued by the Napier
Harbour Board until after such notices shall have
been approved by the Marine Department. Also
such of the powers vested in the Governor by the
said seventh section as enables him to suspend Port
or Harbour Masters, and to appoint, suspend, or
remove other officers of any port or harbour: Pro-
vided that this delegation shall be limited to the Port
of Napier.

The Port of Napier referred to in the foregoing
Order in Council is defined in a Warrant bearing
date the twentieth day of November, one thousand
eight hundred and sixty-eight, and published in the
New Zealand Gazette of the twenty-third day of
November in the same year.

Sections of "The Marine Act, 1867," to the Napier
Harbour Board.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by the sixth section of "The Marine
Act, 1867," (hereinafter called "the said Act,")
it is, among other things, enacted that the Governor in
Council may from time to time delegate all or any of
the powers vested in him by the said Act, subject to
any restrictions or stipulations which may be specified
in such Order; and whereas by an Order in Council
bearing even date herewith, the Governor did, amongst
other things, revoke so much of an Order in Council
bearing date the eighth day of January, one thousand
eight hundred and sixty-eight, as delegated to the
Superintendent of the Province of Hawke's Bay,
and his successors in such office, certain powers
under the twelfth, thirteenth, and forty-second sec-
tions of the said Act; but in the Order in
Council now in recital it was provided that such re-
vocation should operate and extend with respect to
the Port of Napier only: And whereas and by vir-
tue of an Act of the General Assembly of New Zea-
land intituled "The Napier Harbour Board Act,
1875," a Harbour Board for the Port of Napier has
been constituted under the name of "The Napier
Harbour Board": And whereas it is expedient that
the powers conferred upon the Governor by the
twelfth, thirteenth, and forty-second sections of the
said Act should be delegated to the said Board as
hereinafter provided:
