Zealand Settlements Act, 1863," and that the whole
of the said land was duly and effectually set apart,
reserved, and taken under the said Act as sites for
settlement for colonization, and was duly and effec-
tually declared to be required for the purposes of the
said "New Zealand Settlements Act, 1863," and to
be subject to the provisions thereof, and that, for the
purposes of the Act now in recital, the words "due
inquiry" in the said Order in Council should be
deemed and taken to extend to inquiries made and
carried through by persons thereunto appointed by
the Governor: And whereas by "The Commissioners
Powers Act, 1867," provision is made for enabling
Boards or Commissioners, appointed by the Governor
in Council, to examine witnesses on oath, to require
the production of books, papers, writings, deeds, and
other documents, and to exercise the powers and
authorities in the said last-named Act mentioned:
Now, therefore, I, George Augustus Constantine,
Marquis of Normanby, the Governor of the Colony
of New Zealand, in pursuance and in exercise of
the powers and authorities vested in me as aforesaid,
do hereby, with the advice and consent of the Execu-
tive Council of the said Colony, appoint

HERBERT WILLIAM BRABANT,
of Tauranga, Esquire, to be a Commissioner to make
the inquiry required by the said Order in Council,
and by "The Tauranga District Lands Act, 1867,"
and "The Tauranga District Lands Act, 1868," for
the purpose of determining for what persons of the
tribe Ngaite rangi three-fourths in quantity of the
lands in the said Order in Council and in the Acts
last aforesaid shall be set apart, in pursuance of the
said Order in Council and "The Tauranga District
Lands Act, 1867," with all the powers and autho-
rities by "The Commissioners Powers Act, 1867,"
provided in the case of any Board or Commission
appointed or issued, or to be appointed or issued, by
the Governor in Council.

ORDER IN COUNCIL.

At the Government House, at Wellington, this
eleventh day of July, 1876.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by an Order in Council bearing date
the twenty-seventh day of January, one
thousand eight hundred and seventy-one, Henry
Tacy Clarke, of Auckland, Esquire, was appointed a
Commissioner to make a certain inquiry, and with
certain powers in the said Order in Council men-
tioned: And whereas it is expedient that the
appointment of the said Henry Tacy Clarke should
be revoked:

Now, therefore, I, George Augustus Constantine,
Marquis of Normanby, the Governor of the Colony
of New Zealand, in pursuance and exercise of all
powers enabling me in that behalf, do hereby, with
the advice and consent of the Executive Council of
the Colony, revoke the said recited Order in Council,
and the appointment of the said Henry Tacy Clarke
to be a Commissioner thereunder.

Appointing Legal Landing Place at Napier

NORMANBY, Governor.

IN exercise of the power in me for this purpose
vested by "The Customs Regulation Act, 1858,"

I, George Augustus Constantine, Marquis of Nor-
manby, the Governor of the Colony of New Zealand,
do hereby appoint that on and from the day of the
date hereof, the legal landing place at the Port of
Napier shall be within the following limits, viz.,
extending from and including the wharf on the Pilot
Reserve; thence along Customs Street, including the
wharves abutting thereon, to the bridge known as
the Railway Bridge; thence along Railway Quay to
its junction with West Quay, and eighteen (18) chains
measuring southward along West Quay.

Given under the hand of His Excellency the
Most Honorable George Augustus Con-
stantine, Marquis of Normanby, Earl of
Mulgrave, Viscount Normanby, and
Baron Mulgrave of Mulgrave, all in the
County of York, in the Peerage of the
United Kingdom; and Baron Mulgrave
of New Ross, in the County of Wexford,
in the Peerage of Ireland; a Member of
Her Majesty's Most Honorable Privy
Council; Knight Commander of the Most
Distinguished Order of Saint Michael
and Saint George; Governor and Com-
mander-in-Chief in and over Her Ma-
jesty's Colony of New Zealand and its
Dependencies, and Vice-Admiral of the
same; at the Government House, at Wel-
lington, this twenty-seventh day of June,
in the year of our Lord one thousand
eight hundred and seventy-six.

Bye-law of Wanganui Municipal Corporation.

THE following Bye-law, passed by the Municipal
Corporation of the Town of Wanganui, is
published in accordance with the provisions of "The
Municipal Corporations Acts Amendment Act,
1875."

BYE-LAW of the Council of the Borough of Wanga-
nui, made under special order of the said Council
dated the ninth day of May, one thousand eight
hundred and seventy-six, confirmed the seventh day
of June, one thousand eight hundred and seventy-
six, and sealed with the common seal of the said
borough, the seventh day of June, one thousand
eight hundred and seventy-six.

In pursuance of "The Municipal Corporations Act,
1867," and the Acts amending the same, the Council
of the Borough of Wanganui ordain as follows:-

  1. The provisions of section fifty-seven (57), sub-
    division two (2) of Part ten (10) of the thirteenth
    Schedule of "The Municipal Corporations Act,
    1867," shall not be deemed to be limited to carts
    standing or plying for hire, or being used as wood-
    carts, water-carts, or night-carts, but shall apply to
    all carts standing or plying for hire generally, within
    the prescribed space of the Borough of Wanganui.

  2. For the purposes of sections fifty-seven (57) and
    fifty-eight (58) of the aforesaid sub-division, the
    person appearing to be in charge of any cart shall be
    deemed to be the owner thereof.

Passed by the said Council this seventh day
of June, one thousand eight hundred and
seventy-six.
