western boundary of the Porangahau District; to
the South by the southern boundary of the Province
of Hawke's Bay; and to the West by the western
boundary of said province.
And I do declare that this Proclamation shall come
into operation and take effect on the first day of Sep-
tember, one thousand eight hundred and seventy-six.

stantine, Marquis of Normanby, Earl
of Mulgrave, Viscount Normanby, and
Baron Mulgrave of Mulgrave, all in the
County of York, in the Peerage of the
United Kingdom; and Baron Mulgrave

in the Peerage of Ireland; a Member of
Her Majesty's Most Honorable Privy
Council; Knight Commander of the Most
Distinguished Order of Saint Michael and

Notification of Governor's Assent to Construction of
Railway in continuation of a Railway constructed
under "The Kaitangata Railway Act, 1875."

WHEREAS by the seventh subsection of the
fourth section of "The Railway Companies
Act, 1875," (hereinafter called "the said Act,") it
is, amongst other things, enacted that if any such
proposed branch railway as is mentioned in the Act
be approved of, and such approval is signified as
hereinafter provided, then the company may proceed
with the construction of such railway in accordance
with the said Act:
And it is further enacted, That whenever the
Governor shall approve of any proposed branch
railway, he shall, by notice published in the New
Zealand Gazette, declare his assent to the construc-
tion of the railway, and such notice, when so pub-
lished, shall be sufficient notice to the company of
such approval: And whereas the Kaitangata Rail-
way and Coal Company (Limited) have deposited
plans of a proposed railway from Stirling to Kaita-
ngata, at the office of the Supreme Court at Dunedin,
and in other respects complied with the terms of the
said Act: And whereas one-half of the whole body
of the ratepayers resident within the highway dis-
tricts through which the railway is proposed to be
constructed have not objected to the construction of
the railway:
Now therefore, His Excellency the Governor of
New Zealand, in pursuance and exercise of the
powers and authorities conferred on him by the
hereinbefore in part recited Act, and in exercise of
any other power enabling him in this behalf, doth
hereby notify and declare that he assents to the
construction of the said railway from Stirling to
Kaitangata.
Given under the hand of His Excellency the

Mulgrave of Mulgrave, all in the County
of York, in the Peerage of the United

Appointing Mayor of Nelson a Justice of the Peace
under "The Municipal Corporations Act, 1867."
NORMANBY, Governor.
WHEREAS by the one hundred and thirty-third
section of an Act of the General Assembly of
New Zealand, intituled "The Municipal Corporations
Act, 1867," it is enacted that it shall be the duty of
the Town Clerk of every borough, as soon as con-
veniently may be after every election of a Mayor for
such borough, to give notice to the Colonial Secretary
for the time being of such election, and of the person
elected; and it shall be lawful for the Governor, if
he shall think fit, and if such person shall not then be
a Justice of the Peace, by Warrant under his hand,
published in the New Zealand Gazette, to appoint
such person to be a Justice of the Peace for the
colony; and it is also thereby enacted that in every
such appointment it shall be expressed that it is
made under the one hundred and thirty-third section
of the said Act; and it is further declared that such
appointment shall continue in force only during the
Mayoralty of such person, and the person so ap-
pointed shall not, by virtue of such appointment, be
authorized to sit or act as a Justice of the Peace
elsewhere than within the borough:
Now therefore, I, George Augustus Constantine,
Marquis of Normanby, the Governor of the Colony
of New Zealand, in pursuance and exercise of the
said power and authority in me vested in that
behalf, do hereby appoint
EDWARD EVERETT Esq.,
the person elected to be the Mayor of the Borough
of Nelson, to be a Justice of the Peace under the
one hundred and thirty-third section of "The Muni-
cipal Corporations Act, 1867."
