WHEREAS Her Majesty the Queen, by Instruc-
tions under Her Sign Manual, bearing date
the sixth day of November, 1874, did direct and
enjoin me, George Augustus Constantine, Marquis
of Normanby, the Governor of New Zealand, that
I should attend and preside at the meetings of
Her Majesty's Executive Council in New Zealand,
unless when prevented by some necessary or reason-
able cause, and that in my absence such Member as
might be appointed by me in that behalf should
preside at all such meetings of the said Council :
Now therefore, I, George Augustus Constantine,
Marquis of Normanby, the Governor of New Zealand,
in exercise and pursuance of all powers and autho-
rities enabling me in this behalf, do hereby appoint

one of Her Majesty's Executive Council in New
Zealand, to preside at all meetings of said Council
in my absence.
Given under the hand of His Excellency the
Most Honorable George Augustus Con-
stantine, Marquis of Normanby, Earl of
Mulgrave, Viscount Normanby, and Baron
Mulgrave of Mulgrave, all in the County
of York, in the Peerage of the United
Kingdom; and Baron Mulgrave of New
Ross, in the County of Wexford, in the
Peerage of Ireland; a Member of Her
Majesty's Most Honorable Privy Coun-
cil; Knight Commander of the Most
Distinguished Order of Saint Michael
and Saint George; Governor and Com-
mander-in-Chief in and over Her Majesty's
Colony of New Zealand and its Depend-
encies, and Vice-Admiral of the same;
and issued under the Seal of the said
Colony, at Wellington, this twentieth
day of April, in the year of our Lord one
thousand eight hundred and seventy-five.

Limits of Port of Dunedin redefined.
NORMANBY, Governor.
WHEREAS on the twentieth day of November,
one thousand eight hundred and sixty-eight,
certain limits were defined for the Port of Dunedin
under "The Marine Act, 1867," and whereas it is
expedient to redefine the said limits: Now there-
fore, I, George Augustus Constantine, Marquis of
Normanby, the Governor of New Zealand, in pur-
suance of the power and authority in me vested by
the said Act, do hereby order that the limits of the
said Port of Dunedin shall extend to and include all
waters commonly known as the "Harbour of Otago,"
and all waters comprised within a radius of three
miles seaward from Tairoa Head.
Given under the hand of His Excellency the

The Colliery Reserve at Westport declared a portion
of the Security for Construction of the Railway
from Mount Rochfort to Westport.

ORDER IN COUNCIL.
At the Government House, at Wellington, this
nineteenth day of April, 1875.-
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by "The Railways Act, 1874," after
reciting that it is expedient that authority
should be given to the Governor in Council to make
the lands described in the Third Schedule to the
said Act, known as the "Colliery Reserve," and the
proceeds thereof, a security to the colony for a
portion of the cost of the construction of the railway
from Mount Rochfort to Westport, it is enacted that
the Governor in Council may declare the said lands
and the proceeds thereof to be a security for the
whole or any portion of the cost of the construction
of such railway: And whereas it is expedient that
the said lands and the proceeds thereof should be so
declared such security as aforesaid :
Now therefore, His Excellency the Governor of
the Colony of New Zealand, by and with the advice
and consent of the Executive Council of the said
colony, and in exercise and pursuance of the power
and authority conferred upon him by the said Act,
doth hereby declare that the said lands known as the
"Colliery Reserve," described in the Third Schedule
to the said Act and in the Schedule hereto, together
with the proceeds thereof, shall be and the same are
hereby declared to be a security to the colony for
a portion of the cost of the construction of the said
railway from Mount Rochfort to Westport.
SCHEDULE.
ALL that parcel of land containing seventy-three
acres, more or less, being bounded towards the North
by Gladstone Street; towards the East by Palmers-
ton Street; towards the South by Bentham Street;
and towards the West by the Buller River.

WHEREAS by an Act of the General Assembly
of New Zealand, intituled "The Gold Fields
Act, 1866," it is provided that it shall be lawful for
the Governor in Council, under his hand and the
Public Seal of the Colony, from time to time to
delegate to the Superintendent of any province, or to
such other person as the Governor may deem fit, all
or any of the powers vested in the Governor or the
Governor in Council by the said Act, except the
powers conferred by sections twenty-two, forty,
forty-eight, sixty, ninety-six, and one hundred and
