Application for Registration of Trade Marks.
NOTICE is hereby given, that Louis Thoneman, of
Dunedin aforesaid in copartnership with Frederick
Christian Lange and Emil Thoneman, both of Mel-
bourne, in the Colony of Victoria, under the style or
firm of "Lange and Thoneman," Attorneys and
Agents for JOSEPH SELNER, hereinafter mentioned,
has applied on behalf of the said Joseph Selner, of
Düsseldorf, in the Empire of Germany, who is the
sole manufacturer of a certain article of commerce
called and known by the name of "Selner's Bitters,"
to register the following Trade Marks under "The
Trade Marks Act, 1866," namely :-
Description of Trade Mark.
A paper label, coloured dark red, of an octagonal
shape, about three inches and three-quarters of an
inch long, measured longitudinally, and three inches
broad, measured transversely; a gold band about
the sixteenth part of an inch wide, running round the
label parallel with its sides, and distant from the edge
of the label by about its own thickness. Immediately
inside this band, a line in gold is drawn all round the
label parallel with the band. Enclosed within these
is a fanciful floral or device, surmounted by a crown,
all in gold, occupying the whole of the inside of
the label, with the exception of a space about the
centre, being about two square inches in size.
Within this space are the words, in gold letters,
"Selner's Stomach Bitter, Düsseldorf (Germany),"
each word forming a line of itself. The words "Sel-
ner's" and "Bitter" are printed in small Roman
capitals, the word "Stomach" in large capitals, stand-
ing about one quarter of an inch high; the word
"Düsseldorf" in Roman letters about one-eighth of
an inch high, and the word "Germany" enclosed in
brackets of gold, printed in German text. Beneath
this label is a white label about four and one-half
inches long by three-fourths of an inch wide, imme-
diately inside the border of which are drawn two
black lines all round the label. Inside are the words
"Notice. These justly celebrated stomach bitters for
stimulating appetite, are strongly recommanded by
the faculty. Bonn, Juin 1818. Prof. Dr. Galsher."
The word "Notice" being in plain capitals, printed
in black ink, and underlined with a black line. The
remaining words are printed in black italic letters,
with the exception of the words "Celebrated
Stomach Bitters," which are printed in black Roman
capitals. In the right-hand lower corner of the
label is a signature purporting to be a facsimile, in
black letters, of the signature of Dr. Galsher.
The bottles or vessels containing the article, and
upon which the above labels are fixed, will be corked
with a cork having the words "Joseph Selner"
marked on the bottom of the cork, in black letters,
in the form of a circle, having a diameter of about
three-eighths of an inch, enclosing a fantastic device.
And every capsule covering such bottles or vessels
is stamped with the words "Jos: Selner at Düssel-
dorf," in a circle having a diameter of about half an
inch, the word "at" being in the centre.
