ORDER IN COUNCIL.
At the Government House, at Wellington, the
twenty-fifth day of October, 1871.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by "The Harbour Boards Act, 1870,"
it is among other things enacted that the
Governor may, by Order in Council, from time to
time delegate to any Harbour Board constituted
thereunder all or any of the powers and authorities
vested in him by the provisions contained in the
seventh and tenth sections of "The Marine Act,
1867," subject to any regulations, restrictions, or
stipulations that may be specified in such Order, and
every such delegation may from time to time alter or
revoke:
And whereas it is expedient that certain powers
should be delegated to the Auckland Harbour Board
as in manner hereinafter set forth:
Now therefore, I, Sir George Ferguson Bowen,
the Governor of the Colony of New Zealand, by and
with the advice of the Executive Council of the
said Colony, in pursuance and exercise of the herein-
before recited power and authority enabling me in
that behalf, do hereby delegate unto
THE AUCKLAND HARBOUR BOARD,
as such Board is constituted by virtue of an Act of
the Superintendent and Provincial Council of the
Province of Auckland, intituled "The Auckland
Harbour Board Act, 1871," the several powers and
authorities mentioned and set forth in the Schedule
hereto annexed, such powers and authorities to be
exercised within the limits of the Port of Auckland,
as therein also mentioned, subject however to such
restrictions as in the said Schedule set forth.
And in further pursuance and exercise of the
hereinbefore in part recited power, and with the
like advice and consent as aforesaid, I do hereby
delegate unto the said Auckland Harbour Board all
the powers vested in the Governor in Council by the
tenth section of "The Marine Act, 1867:" Provided
that the delegation lastly hereinbefore contained shall
be limited to the said Port of Auckland.
SCHEDULE.
Such of the powers vested in the Governor by the
seventh section of "The Marine Act, 1867," as
enable him to erect, superintend, and maintain
harbour marks, buoys, lights, and beacons within
the limits of the Port of Auckland, or the approaches
thereto : Subject however to such directions as may
from time to time be issued by the Marine Depart-
ment of the General Government, as to the size,
position, and colour of such harbour marks, buoys,
lights, and beacons.
The Port of Auckland, referred to in the foregoing
Order in Council, is defined in the Schedule to an
Order in Council, bearing date the 20th day of
November, 1868, and published in the New Zealand
Gazette of the 23rd day of November, in the same
year.

ORDER IN COUNCIL.

WHEREAS by "The Harbour Boards Act,
1870," it is amongst other things enacted that
the Governor in Council may for each Province in
New Zealand from time to time make, alter, and
repeal regulations for providing whether any and
what officers shall, by virtue of their office, be members
of any Board constituted under the said Act:
Now therefore I, Sir George Ferguson Bowen, the
Governor of the Colony of New Zealand, by and with
the advice and consent of the Executive Council of
the said Colony, in pursuance and exercise of the
power and authority vested in me for that purpose,
do hereby make the following Regulations :β
REGULATIONS.
"The Collector of Customs for the time being at
the Port of Auckland shall be a Member of the
Auckland Harbour Board, as the same is constituted
under the provisions of an Act of the Superintendent
