WHEREAS the Regulations relating to Criminal
Prosecutions, published in the New Zealand
Gazette, March 3, 1864, and December 21, 1867, so
far as the same provide for the conduct of prosecu-
tions by the Crown Solicitors, were not intended and
ought not to apply to cases the responsibility of
prosecuting which ought to remain with the person
instituting the prosecution. It is therefore notified
that the said Regulations, so far as aforesaid, do not,
unless the prosecution is instituted by or by the
direction of some Department of the General Govern-
ment, or by or by'the direction of a Judicial Officer
or Superior Officer of Police, apply to other than the
following misdemeanours :-

Conspiring to charge any person with any
felony, or to indict any person of any felony.
Conspiring to commit any felony.
Neglect and breach of duty as a Peace Officer.
Misdemeanours under "The Larceny Act, 1867."
Misdemeanours under "The Offences against
the Person Act, 1867."
Misdemeanours under "The Malicious Injuries
to Property Act, 1867."
Misdemeanours under "The Forgery Act, 1867,"
Misdemeanours under "The Coinage Act, 1867."

  1. In cases to which the said Regulations are
    declared not to apply, the committing Justices should
    be careful to inform prosecutors to that effect.

  2. In cases to which the Regulations do apply, a
    strict compliance with the third and fourth of the
    Regulations first above mentioned is enjoined on all
    Justices of the Peace.

  3. If the Attorney-General or Crown Solicitor is of
    opinion that any prosecution instituted by a private
    prosecutor, whether for felony or misdemeanour,
    and to which the said Regulations would otherwise
    apply, is such that it ought not to be conducted by
    the Crown Solicitor, notice thereof shall, as soon as
    possible, be given to the prosecutor; and if such
    notice shall be given to the prosecutor not later
    than seven days in country cases, and not later
    than three days in town cases, before the first day
    of the sittings at which the trial is to be had, or if
    the committal shall have taken place within the said
    periods, then, if such notice be given with all
    reasonable despatch, in all such cases the Crown
    Solicitor shall not conduct the prosecution under the
    said Regulations, and the said Regulations shall not
    be deemed to apply to such case.

By a "country case" is meant one in which the
committing Justices shall have sat at a distance of
more than ten miles from the place at which the trial
is to be had. Other cases are included in the term
"town cases."

The alteration of the said Regulations shall apply
to cases in which Justices shall commit or hold to
bail after the 1st July next; and if the alteration shall
be made known to any Justice before that date, it
shall apply to all cases in which any such Justice
shall commit or hold to bail after the alteration is
made known to him.

WILLIAM NEWSHAM BLAIR, Esq.,
a District Engineer under "The Immigration and
Public Works Act, 1870." This appointment to date
from the 1st instant.

CUSTOMS. - In exercise of the powers in me for
this purpose vested by "The Customs Regula-
tion Act, 1858," I, the Commissioner of Customs, do
hereby approve and appoint the under-mentioned
Warehouse, namely:-

Port of Auckland.
The inner half of a Warehouse built of concrete, on
part of allotment (19) nineteen of section (9) nine
of the Town of Auckland, and known as
THE KEROSINE BOND,
to be a Warehouse for the reception and storage of
Kerosine and other Oils under Bond.

Given under my hand at Wellington, this
nineteenth day of May, one thousand
eight hundred and seventy-one.
