Dunedin, in the Province of Otago aforesaid,
creditor of the said Charles de Vere Teschemaker,
to the extent of not less than Fifty pounds, and
in the matter of "The Debtors and Creditors
Act, 1862."

Before His Honor Mr. Justice Chapman.

UPON the application of James Bartholomew
Schlotel, a creditor of the above-named Charles
de Vere Teschemaker, and upon hearing Mr. Maddock,
the solicitor for the applicant, and Mr. Dempsey, the
solicitor for the said Charles de Vere Teschemaker,
and for Martin Sholl, and upon reading the order of
His Honor Mr. Justice Richmond, made in these
matters, dated the eighteenth day of July, one
thousand eight hundred and sixty-five, the deed of
conveyance and assignment executed in pursuance
thereof by Robert Chapman, Esquire, the Registrar
of this Court, dated the first day of August, one
thousand eight hundred and sixty-five; and the
affidavit of William Downie Stewart, filed in these
matters on or about the fifth day of April, instant,
I do order that so much of the said order as directs
"That the Registrar of the Supreme Court do convey
to Martin Sholl all the real and personal estate of
the said Charles de Vere Teschemaker, whether in
possession, expectancy, reversion, or otherwise, sub-
ject to the usual trusts for the benefit of creditors
who shall prove their debts in accordance with the
rules of this Court, within the period of six months
from the date of the said deed, or within such further
time as the Court shall from time to time in that
behalf appoint," be, and the same is hereby discharged,
and that the said deed of conveyance and assignment
executed in pursuance thereof be cancelled: And I
further order that the said Charles de Vere Tesche-
maker do forthwith cede and deliver, convey and
assign, unto the said Martin Sholl, his heirs, execu-
tors, administrators, and assigns, according to the
nature and quality thereof respectively, all the estate
and effects of the said Charles de Vere Teschemaker,
upon trust for the purpose of selling, disposing of,
getting in and receiving, or otherwise realizing the
same, and in the first place paying, satisfying, and
discharging all costs, charges, and expenses incurred
by order of this Court, or incidental to the execution
of the trusts of the conveyance and assignment to be
made in pursuance of this order, and all fees of Court
and other fees, if any, payable under the said
"Debtors and Creditors Act, 1862," or "The Debtors
and Creditors Act Amendment Act, 1865," and such
other sums of money, if any, as shall be ordered by
this Court, and five pounds per cent. commission as
in the said order mentioned; and subject as aforesaid
for the purpose of justly distributing and administer-
ing the clear residue of the said moneys between and
amongst and for the benefit of all the creditors of the
said Charles de Vere Teschemaker at the time of the
presentation of his said petition, and who have duly
proved their debts by affidavit in accordance with the
rules of this Court, within six calendar months from
the date of the said deed of the first day of August,
one thousand eight hundred and sixty-five, or who
have or shall prove their debts within such further
time as in the said order mentioned by way of pro
rata distribution, subject to existing legal priorities;
and if there shall be any surplus of the said moneys
after answering the purposes aforesaid, shall pay such
surplus to the said Charles de Vere Teschemaker:
And I further order that the Registrar of this Court
at Dunedin shall make and execute such cession and
delivery, conveyance and assignment, in the name
and on behalf of the said Charles de Vere Tesche-
maker, and that the conveyance and assignment
hereby directed to be made shall contain all requisite
powers for enabling the said Martin Sholl to recover
and receive debts, moneys, goods, chattels, estate and
effects in any way belonging to or due and payable
to the said Charles de Vere Teschemaker.

hundred and sixty-six.

I, the undersigned ROBERT GILLIES, hereby make
application to register "The Dry Bread Water
Race Company, Registered," under the provisions of
"The Mining Companies Limited Liability Act,
1865," and I do solemnly and sincerely declare that
the following statement is, to the best of my belief
and knowledge, true in every particular, namely:-

  1. The name of the Company is "The Dry Bread
    Water Race Company, Registered."
  2. The place of operations is at Thompson's.
  3. The nominal capital of the Company is two
    thousand seven hundred pounds, in two hundred and
    seventy shares of ten pounds each.
  4. The amount already paid up is two thousand
    seven hundred pounds.
  5. The name of the manager is Robert Gillies.
  6. The office of the Company is at the corner of
    Dowling Street and Prince's Street, Dunedin.
  7. The names and several residences of the share-
    holders and the number of shares held by each at this
