ORDER IN COUNCIL,
Appointing Regulations for the Native District of
"Wharekauri," Chatham Islands.

At the Government House, at Wellington, on the
twenty-eighth day of June, 1865.
Present :
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by an Act of the General Assembly
of New Zealand, intituled, "The Native
Districts Regulation Act, 1858," it is provided that
it shall be lawful for the Governor in Council from
time to time to appoint Districts for the purposes of
the said Act, being districts over which the Native
Title shall not for the time being have been extin-
guished; And whereas by an Order in Council
bearing date the twenty-eight day of January, one
thousand eight hundred and sixty-four, the District
of Wharekauri was appointed for the purposes of the
said Act ; And whereas it is further provided by the
said Act that it shall be lawful for the Governor in
Council, from time to time, to make and put in force
within any such district, Regulations (among other
things) for the branding or marking of Cattle, in
order to the proof of the ownership thereof, and for
the prevention of fraud in relation to the branding or
marking of cattle, and for the prevention of larceny
of cattle, or of the flesh, hides, or skins thereof, and
for the suppression of the nuisance of dogs wandering
at large, and for defining and prescribing the rights,
duties and liabilities of the owners of dogs, and of all
other persons, in relation to dogs wandering at large,
and that it shall be lawful by any such regulation to
impose penalties not exceeding Fifty pounds for the
breach or non-observance of any such regulation, and
that all such regulations shall be made as far as
possible with the general assent of the Native
population affected thereby, to be ascertained in such
manner as the Governor may deem fitting; And
whereas it is expedient to make and put in force the
following regulations relating to the branding of
cattle and the suppression of the nuisance of dogs
within the district aforesaid:
Now therefore His Excellency the Governor, by
and with the advice and consent of the Executive
Council of New Zealand, doth hereby make and put
in force within the said District of Wharekauri, the
following regulations, that is to say-
-
All horses, cattle, and sheep to be branded
before attaining the age of one year. All
unbranded at the expiration of that period to
become the property of the public. -
A register of all brands shall be kept, the fee
for registry to be two shillings and sixpence
sterling (2s. 6d.) -
All persons now in possession of brands shall
register the same before the first of June
next. -
All persons not now in possession of brands
shall register the same on or before the first
of April, 1867. -
All horses, cattle, and sheep, above the age of
one year, found unbranded after the first of
April, 1867, shall become the property of the
public. -
Any person convicted of defacing the brand on
any animal, shall suffer a penalty not exceed-...
ing Fifty pounds sterling. -
No stranger, whether White man or Maori,
shall shoot or destroy cattle without the
consent of the Native assessor of the village. -
The books of registry of brands and the moneys
resulting therefrom, shall be kept in the hands
of the persons appointed for each district and
presented to the Runanga at each meeting.
The persons appointed for each district are-
Tangari Te Umu, for Waitanga, and Pamariki
Raumori, for Kaingaroa..
(1.) All dogs to be registered in a book kept for
that purpose before the expiration of one year
of age.
(2.) The fee for registry for each dog shall be five
shillings (5s.)
(3.) All dogs shall be kept tied with a chain or
rope.
(4.) All dogs wandering at large shall be seized by
the constable, to whom payment shall be made
by the owner of Two shillings. Should the
owner refuse to pay the dog to be destroyed.
(5.) For all property destroyed by dogs a fair
compensation shall be paid.
(6.) All dogs found chasing or worrying sheep,
cattle, pigs, and poultry, may be destroyed by
the owners of the same whether the dog is
registered or not.
(7.) All dogs wandering on a sheep run only may
be destroyed whether registered or not.
(8.) All registers and fees arising therefrom shall
be in the charge of the constable of each
village, and shall be presented to the Runanga
at each meeting.
And doth hereby order and appoint that this Order
shall take effect from and after the twenty-eighth
day of June, 1865.
