PROCLAMATION.

By His Excellency Sir GEORGE GREY, Knight
Commander of the Most Honorable Order
of the Bath, Governor and Commander-
in-Chief in and over Her Majesty's
Colony of New Zealand and its Depend-
encies, and Vice-Admiral of the same,
&c., &c., &c.

WHEREAS by "The Wild Birds' Protection Act,
1864," it is enacted that the second section of
the said Act shall have no force or effect except in
such portions of the Colony as shall from time to
time be proclaimed by the Governor to come within
the operation of such section.

Now, therefore, I, Sir George Grey, the Governor
of the Colony of New Zealand, do hereby proclaim
the Province of Otago to be within the operation of
the second section of the above recited Act.

the Seal of the Colony of New Zealand,
this fourth day of March, in the year of
our Lord one thousand eight hundred

fourth day of March, 1865.
Present-

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by "The Marine Board Act, 1863,"
it is enacted that it shall be lawful for the
Governor in Council from time to time to make such
regulations as may be found necessary respecting the
anchoring and mooring of vessels in any port; the
packing, landing, deposit, and removal of gunpowder;
the erection of magazines for the safe keeping
thereof; the watering and ballasting and discharging
of ballast of or from vessels, and all other matters
relating to the safe and commodious navigation of
any Port, Harbour, or River, and the order and
management of vessels resorting thereto; and for the
purpose of giving effect to such regulations to
authorise the levying of Harbour Masters' Fees, not
exceeding the rate specified in the Schedule to the
said Act; and to impose any penalty not exceeding
Twenty Pounds for any one offence against any
provisions thereof.

Now, therefore, His Excellency the Governor, with
the advice and consent of the Executive Council of
New Zealand, in pursuance and exercise of the above
recited power and authority, doth hereby make the
following regulations for the Port of Lyttelton, within
the Province of Canterbury.

And doth order that the same shall come into
operation and take effect from and after the 24th day
of April, 1865.

Port Regulations.

  1. The regulations published in the Provincial
    Government Gazette of October 11, 1864, under the
    title of "Watermen's Regulations," are hereby re-
    pealed, and the following regulations shall be in force
    in the Port of Lyttelton on and after the 26th day of
    October, 1864.

  2. All Carters, Porters, and Watermen engaged
    upon the public wharfs shall be under the control of
    the Port Officer.

  3. Every Waterman shall, upon payment of One
    Pound sterling in respect of every boat to be plied by
    him, receive a license, to be renewed on the 1st July
    in each year.

  4. Any Boatman carrying passengers for hire with-
    out a license shall be liable to a fine not exceeding
    Five Pounds.

  5. No boat shall be allowed to remain at any
    landing-place after discharging her cargo and passen-
    gers, or to make fast to any steps or handrails
    belonging thereto, without some person in charge
    ready to remove the said boat when required to do so
    by the Port Officer or person deputed by him.

  6. A Board, exhibiting the charges authorised to
    be made between sunrise and sunset, shall be placed
    near the landing-place. After sunset, and when the
    blue flag shall be hoisted half-mast by the Harbour
    Master or person deputed by him, denoting bad
    weather, double fares can be demanded by watermen.

  7. Any Boatman resisting, impeding, or obstruct-
    ing the Harbour Master, Pilot, or other person
    deputed by either of them in the execution of his
    duty, or using threatening or abusive language to
    them, or any of them, shall forfeit and pay a sum
    not exceeding Fifty Pounds.

  8. The number of passengers allowed to be carried
    in any boat shall be specified in the license, and shall
    be legibly painted on some conspicuous part of the
    boat in respect of which such license is issued; and
    any Boatman conveying a larger number of passen-
    gers, or a greater quantity of luggage, than is allowed
    in his license, shall forfeit and pay a sum not
    exceeding Five Pounds.

  9. The authorised fares shall be as followsβ€”
    From any wharf or jetty to the steamers,
    single fare to or from - - - 1 6
    From any wharf or jetty to any place,
    or to any vessel other than steamers,
    lying within a space bounded on the
    East by a line drawn from Stoddart's
    to Sticking Point, and on the West
    by a line drawn from Naval Point to
    the Eastern portion of Church Bay 2 0
    From any wharf or jetty to Church Bay 6 0
    From any wharf or jetty to Gollan's
    Bay - - - - - 4 6
    From any wharf or jetty to Rhodes'
    Bay:
    One passenger - - - - 5 0
    Two or more, each - - - 2 6
    From any wharf or jetty to Quarantine
    Station:
    One passenger - - - 20 0
    Two or more, each - - 10 0
    To the Heads, or Head of the Bay, as
    per agreement.
    Return fares will be allowed at the
    same rate in each case.
