Title shall not for the time being have been
extinguished:
Now therefore, His Excellency the Gover-
nor, by and with the advice and consent of his
Executive Council, doth hereby order, ap-
point, and declare that the Territory hereafter
described shall be a District for the purposes
of the said Act, that is to say: All Territory
lying within a boundary line commencing at
the mouth of the Waikato river, and follow-
ing its course to Mangatawhiri, thence along
the course of that stream to Paparata, thence
in a South-easterly direction to and along a
ridge of hills to a point due East of the point of
junction of the Waipa and Horotiu rivers at
Ngaruawahia, thence by a line passing through
the said point of junction at Ngaruawahia and
continued Westerly to the mouth of the river
Waikoria on the West Coast, thence Nor- herly along the sea coast to the point of
commencement; excepting all lands over
which the Native Title has been extinguished
within the meaning of the said Act.
And doth appoint and declare that the said
District shall be called the Native District
of Lower Waikato.
And doth declare that this Order shall
take effect from and after the third day of
February, 1864.

"Public Domains Act, 1860,"

fifth day of February, 1864.

HIS EXCELLENCY THE GOVERNOR IN
COUNCIL.
WHEREAS by the "Public Domains
Act, 1860," it is enacted that the
Governor may from time to time, by Order
in Council, delegate all or any of the powers
for any period, and subject to such stipula-
tions, as may be specified in such order:
Now therefore, His Excellency the Gover-
nor, by and with the advice and consent of
the Executive Council of the Colony, doth
by this present order delegate, until this
Order shall be revoked, all the powers con-
ferred by the said Act, except the powers
under sub-sections 2, 5, and 10 of Section 5
and under Section 11, to Charles Knight,
Esquire, who shall be Chairman, Robert
Graham, Esquire, John Anderson Gilfillan,
Esquire, William Gisborne, Esquire, and
George Burgoyne Owen, Esquire, subject to
the stipulations hereinafter contained:

None of the powers delegated shall be
exercised in respect of any land in the actual
occupation of the Governor, except at his
instance and request, nor in respect of any
land described in Section 3 of the Schedule
to the said Act. -
The Board shall meet at such times and
places as shall be from time to time ap-
pointed by the Chairman or shall be con-
vened by him.
The Board shall keep proper Minutes and
Records of its proceedings.
Two Members of the Board shall form a
quorum.
All questions shall be determined by a
majority of the Members of the Board pre-
sent at a meeting. The Chairman to have
a casting as well as an original vote.

CUSTOMS.
Government Order 44, Establishing the Port of
Waikato.
By His Excellency Sir George Grey,
Knight, Commander of the most
honorable Order of the Bath,
Governor and Commander-in
Chief in and over Her Majesty's
Colony of New Zealand and its
Dependencies, and Vice-Admiral
of the same, &c., &c.
IN exercise of the power in me for this pur-
pose vested by the "Customs Regulation
Act, 1858," I, Sir George Grey, the Gover-
nor of the Colony of New Zealand, do hereby
appoint that, on and from the day of the date
hereof, there shall be, within the Province of
Auckland, a Port at the entrance of the
Waikato River, to be called Port Waikato,
the limits whereof shall be as follows:-
Bounded on the South by a line running
East, for the distance of two miles, from a
point one mile South of the South Head of
Waikato entrance; on the North by a line
running East, for a distance of two miles,
from a point one mile North of the North
Head of Waikato entrance; on the East by
a line running North and South between
the extremities of the before-men-
tioned boundaries; and on the West by a
line running North and South, joining the
Western extremities of the before-mentioned
boundaries.
Given under my hand, at Govern-
ment House, at Auckland, this
fourth day of February, one
thousand eight hundred and sixty-
four.
