His Excellency the Governor in Council.
W HEREAS by the "Resident Magis-
trates' Court Act, 1858," it is enacted
that the Fees to be taken in respect of any pro-
ceedings in any Resident Magistrate's Court
may be varied, abolished, and fixed, as the Go-
vernor in Council shall from time to time direct
and appoint:
Now, therefore, His Excellency the Gover-
nor by and with the advice and consent of the
Executive Council, doth hereby direct and ap-
point that the Fees to be taken in respect of
proceedings in the Resident Magistrate's Courts
held within any District constituted a Gold
Field under the "Gold Fields' Act, 1858,"
shall be as follows, namely,–

His Excellency the Governor in Council.
W HEREAS by the "Post Office Act,
1858," it is amongst other things
enacted that it shall be lawful for the Governor
in Council, from time to time, to make Rules
and Regulations for the managing of the several
Post Offices, for the receiving, despatching,
conveying, and delivering of letters (including
the imposition of fees for private boxes and de-
liveries,) for the detaining, opening, and return
or other disposal of irregularly posted, un-
claimed, or refused letters, or such as from any
cause whatever cannot be delivered or forward-
ed, and the contents thereof respectively, and
for the publication of the lists of the same, for
the making, custody, and sale of postage labels,
for the receiving and paying of money in con-
nection with the said Postal service, and for the
conduct of post officers, and any such Rules and
Regulations at any time in force to alter, vary,
or revoke: And whereas, in pursuance and ex-
ercise of the said recited power and authority,
His Excellency the Governor in Council did,
by a Proclamation bearing date the thirteenth
day of January, one thousand eight hundred
and fifty-nine, make certain Rules and Regula-
tions for the management of the Post Offices,
and for the guidance of the officers therein em-
ployed; and further, by an Order in Council,
dated the twenty-fifth day of November, one
thousand eight hundred and fifty-nine, did
make certain additional Rules and Regulations
for the purpose aforesaid :
Now, therefore, His Excellency the Gover-
nor, by and with the advice and consent of the
Executive Council, doth, by this present Order,
in pursuance and further exercise of the said
recited power and authority, make the follow-
ing additional Rules and Regulations :—
-
Every packet intended to be transmitted
as a book packet must be sent either without a
cover, or in a cover, open at the ends or sides,
and the full postage thereof must be prepaid. -
The packet may contain any number of
separate books or other publications, prints, or
maps, and any quantity of paper, parchment,
or vellum (to the exclusion, however, of letters,
whether sealed or open), and the books or other
publications, prints, maps, &c., may be either
written, printed, or plain, or any mixture of the
three. Further, all legitimate binding, mount-
ing, or covering of a book, publication, &c.,
or of a portion thereof, will be allowed, whether
such binding, &c., be loose or attached, as also
rollers in the case of prints or maps, markers
(whether of paper or otherwise) in the case of
books, and in short whatever is necessary for
the safe transmission of literary or artistic
matter, or usually appertains thereto. -
The packet must not contain any letter,
closed or open, or any enclosure sealed or other-
wise closed against inspection, nor must there
be any letter, or any communication of the
nature of a letter, written or printed in any
such packet or on its cover. -
No book packet can be received if it
exceeds two feet in length or one foot in width
or depth. -
Any packet which shall not be open at
the ends or sides, or shall have any letter or
any communication of the nature of a letter
written or printed in it or upon its cover, is
charged with letter postage. -
No Postmaster shall be required to ac-
cept for transmission by any overland mail a
book packet, which from its weight or for any
other reason, may appear calculated to retard
the carrier or otherwise to cause inconvenience.
