of Messrs. G. T. Clayton & Co., and
lately occupied by Mr. Brown, Turner,
where he has on hand every variety of
Grocery, Haberdashery, Glass and
Crockeryware, Wholesale and Retail.
T. S. will be glad to receive GOODS
of any kind, on Commission from those
who may please to honor him with their
commands. All accounts will be settled,
with expedition.

great loss from Goats destroying
my Garden and Fruit Trees; I hereby
Caution all those persons who own Goats
to keep them fastened up, or if they are
found trespassing on my Property, I shall
proceed according to the Impounding Act.

of the Colony of New
Zealand, &c., &c., &c.,
The Memorial of Michael Fitz-
patrick, late of Sydney, but
at present residing at Alu-
tavia,
SHEWETH,
THAT your Memorialist, who had been
carrying on a respectable and lucra-
tive Business in the Colony of New South
Wales as a Boot and Shoe Maker,
having a Brother, who has resided in New
Zealand upwards of two years, was in-
duced to emigrate thither with his family,
and from representations made to him that
a well conducted Hotel was required, and
would be likely to open parties em-
barking in that business, - your Memorialist
disposed of his Business in Sydney, and at
considerable expense furnished himself with
every thing necessary for conducting a
respectable establishment, bringing with
him also a small Capital.
That your Memorialist has been in New
Zealand about four months and about half
months since he succeeded in renting his
present Residence (which had been previ-
ously established as a Boarding House and
Family Hotel, and is the only house on
the line of road from Kororareka to Rus-
sell.) as a place calculated for his intended
business, and for which he has paid eigh-
teen months Rent in advance.
That your Memorialist having been
informed that it would be necessary to
apply for a License, sent an application to
the Bench of Magistrates, in conformity
with the Act of Council - that your Memo-
rialist, after having attended the Court
three sittings, enquired of Mr. Woods,
Chief Constable, if his application had
been granted, when Mr. Woods replied,
that it was granted, by which your
Memorialist understood that all was cor-
rect, and that a License would be issued
to him at the same time with other appli-
cants, and your Memorialist, in consequence,
at considerable labour and expense, caused
a good Road to be made from Kororareka
to Matavia (the only line to Russell Town)
advertised his Business in the public
Newspaper, and acted as an Inn-Keeper,
as all others did who had similarly ap-
plied for Licenses, always considering that
he was acting according to Law, and that
he would have to pay for his License when
called upon.
That your Memorialist was ignorant of
the necessity of obtaining from the Bench
a Certificate, that his License would be
granted, and, in consequence of his not
procuring such Certificate, no information
was filed against him for selling without
a License, and upon the hearing of
his case, your Memorialist will be liable to
be fined, and to be fined Β£50 under the
Act of Council.
That a License has been issued in a case
where no Certificate had been previously
granted, to a person named Thomas Dunn,
of Kororareka.
Your Memorialist therefore humbly
prays, that Your Excellency will be
pleased to take the foregoing circumstances
into consideration, and, also, that if your
Memorialist be deprived of a License, he
will be subjected to great loss in the
sacrifice of his Stock-in-Trade, which will,
in that event, become useless to him, in
addition to the great expense he has
already incurred, and which has very
materially reduced his small property;
and, further, that Your Excellency
will cause a further enquiry to be made
into the circumstances, so that your Me-
morialist may be furnished with a License
which he verily believed had been granted
to him, or in any other manner give to
your Memorialist such relief as to your
Excellency shall seem meet.
And your Memorialist as in duty bound
shall ever pray, &c.

We, the undersigned, believe the con-
tents of the foregoing Memorial to be true,
and that Michael Fitzpatrick is a man of
good character, and fit to be entrusted with
a Publican's License, and beg to recom-
mend to Your Excellency's consideration
the prayer of his Memorial.

We respectfully to inform all parties
interested in this Office, that as it is
impossible to conduct an Establishment
at this cost, without heavy expences, we
shall be under the sole necessity of
charging the rate of Banking discount
upon all arrears not paid up before the
close of our current Quarter, ending
December 31st.
Let it not be forgotten that we are labouring
(under all the disadvantages of the pre-
sent state of things), for this general
good.

"The great question of justice to Abori-
gines must, in this day of enlightenment, be
frequently discussed, and the discussion of
it cannot fail to issue in an amelioration
of European policy with regard to them.
Every occurrence between civilized and
uncivilized men, is calculated to lead to
victory on the side of philanthropy. How-
ever, the best informed Nations, and the
most politic of Governors, have yet to
learn on this subject yet. A vehement
controversy has been excited at Adelaide,
South Australia, by the instructions of
Governor Gawler to Major O'Halloran,
under which that officer punished with
death two men who had been concerned
in the massacre of the passengers of the
unfortunate brig Maria. In a Minute
laid by the Lieutenant Governor to the Legis-
lative Council, he enters at length into
the subject, asserting his views and pro-
ceedings. The South Australian paper,
which is in the opposition, while the
South Australian, formerly so
strongly opposed to him, maintains the pro-
priety of the Governor's proceedings."
