THE Superintendent directs it to be notified that the Justices' Orders, dated respectively the 22nd day of November, 1870, granting the alteration of certain Roads in the Districts of Moutere and Waiwero, as described in the application of John Blackett, Provincial Engineer, and Henry Lewis, Chief Surveyor, published in the Nelson Government Gazette, No. 29, of the 4th October, 1870, have been confirmed by the Superintendent and Executive Council.

PROTECTION is hereby granted, subject to the following conditions, for FIVE YEARS from this date, under the provisions of "The Goldfields Act, 1866," to WILLIAM COURTNEY, of Westport, Contractor, for a TRAMWAY to be constructed by him from the corner of Wharf and Bright streets, Westport, to Atkinson's Hotel, near the Orawaiti Bridge, and the said William Courtney is hereby authorised, subject to the following conditions, to charge the tolls hereinafter specified, during the term of this Protection :—

  1. Situation of line to be defined by the District Engineer, to follow the road alongside the footpath, and shall not interfere with the traffic over the Orawaiti Bridge.
  2. The tramway to be kept in good working order and repair during the whole of the term, to the satisfaction of the District Engineer.
  3. The tramway to be completed by the Thirty-first of December, 1870.
  4. That a properly-constructed track shall be run each way at least eight times every day, except Sundays, at regular stated times, between the hours of eight o'clock a.m. and eight o'clock p.m.
  5. That a good lamp, properly lighted, shall be carried in front of the truck when running on dark nights.
  6. The tolls shall not exceed the following, viz.:—
    For every passenger between the hours of eight o'clock a.m. and eight o'clock p.m., One Shilling; and from 8 p.m. to 8 a.m., One Shilling and Sixpence.
  7. The Superintendent reserves the right to cancel this protection at any time during the said term of five years, if any of the above conditions are not carried out to his satisfaction, and in the event of any complaint arising, the Superintendent may suspend the operation of this protection until the matter has been enquired into and decided upon.
  8. Should this protection be cancelled, as provided by clause 7 hereof, the said tramway shall become the property of the Provincial Government, and the Superintendent shall have the right to immediate possession thereof; and the said William Courtney shall not be entitled to any compensation or payment for the same.
  9. At the expiration of the term for which this protection is granted, the Provincial Government shall have the right of purchasing the said tramway, at a valuation to be made in the usual way; but should the Government decline to exercise the right of purchase, then the said William Courtney shall be allowed a reasonable time to remove said tramway.
  10. No tolls shall be recoverable unless it be proved to the satisfaction of the Warden that the tramway is in fair working order.
  11. This protection shall not be transferred or assigned without the sanction of the Superintendent.
