Nelson, 26th September, 1868.
JOHN FLETCHER, WILLIAM BAILEY, and FREDERICK BOARDMAN, are hereby authorised to construct a TRAMWAY for a distance of about 70 chains commencing about 30 chains north of Marshall and Company's claim, on the CALEDONIAN TERRACE, and running thence through the TOWNSHIP; And protection is hereby granted for the same for twelve months from this date in accordance with the provisions of the XIII Section of "The Goldfields Act, 1866," on the following conditions, viz.:β
The Tramway shall be laid down in such a manner in the centre of the street, that it shall not in the slightest degree impede, obstruct, or interfere with the traffic thereof.
The work shall be commenced forthwith, and continuously proceeded with and completed within two months.
The Tramway shall not interfere with any existing rights or privileges.
In the event of the ground proving auriferous, any person shall be entitled to work it on first making an equally good portion of Tramway, or paying compensation at a valuation.
This protection shall extend only to the ground over which the Tramway passes, and shall not affect the right of any other person or persons to lay down Tramways in any direction, and if at any time any portion of the ground is required by the Government, the Tramway or any portion of it may be taken at a valuation.
