NOTICE is hereby given, that, in
accordance with the provisions of the
Nelson Waste Lands Act, 1863, the follow-
ing sections are withdrawn from sale, viz.:β€”

Nos. 78, 80, 82, 84, 86, 88, and 90, in the
District of Upper Motueka.

ZEALAND, MIDDLE DISTRICT.

In the matter of the "Debtors and Credi-
tors Act, 1862," and in the matter
of the Petition of ISRAEL JOHNS and
THOMAS TREWHEELLAR, of the City
of Nelson, in the Middle District,
Millers, Bakers, and Confectioners;
and in the matter of the Petition of
J. H. LEVIEN and Co., and others,
Creditors of the above-named Israel
Johns and THOMAS TREWHEELLAR.

On Friday, the 24th day of February, 1865.

UPON reading the Petition of the
above-named Israel Johns and Thomas
Trewheellar, and the Petition of the above-
named J. H. Levien and Co., and others,
Creditors of the said Israel Johns and Thomas
Trewheellar; upon reading the several sche-
dules and affidavits to the said Petitions
respectively annexed; and upon hearing Mr.
Hart, of counsel, for the said Petitioners:
It is ordered, that, unless cause to the con-
trary be shown at Wellington, before the
20th day of March now next ensuing, a
MEETING of the CREDITORS of the
said Israel Johns Trewheellar
be held on such day, in the month of April,
now next ensuing, and at such place as the
Registrar at Nelson, of the Supreme Court
of New Zealand, shall fix for that purpose,
for the purpose of recommending to this
Court the Trustees to be appointed, of the
Estate and Effects of the said Israel Johns
and Thomas Trewheellar, for the benefit of
their Creditors, according to the provisions
of the "Debtors and Creditors Act, 1862;"
and for the further purpose of recommending
to this Court the mode to be adopted for
carrying on and winding up the business of
the said Petitioners, Israel Johns and
Thomas Trewheellar, for the benefit of their
said Creditors.

UPON reading the Petition of the
above-named Israel Johns and Thomas
Trewheellar, in filed in this Court, and the
several schedules and affidavits thereto
annexed, and upon hearing Mr. Hart, of
counsel for the said Petitioners: It is ordered
that the said Petition shall be set down for
hearing, at the Supreme Court House, Nel-
son, upon a day in the month of May, now
next ensuing, to be fixed by the Registrar at
Nelson of the Supreme Court: And it is fur-
ther ordered that, until the day so to be fixed
as hereinbefore mentioned for the hearing of
the said Petition, the Persons and Estate of
the said Israel Johns and Thomas Trewheel-
lar be protected from arrest, execution, or
other legal process; and further, that until
the said day so to be fixed as aforesaid, the
Estate and Effects of the said Israel Johns
and Thomas Trewheellar be placed under
sequestration, in the hands of John Beit, of
the City of Nelson, aforesaid, Merchant;
JOSEPH HENRY LEVIEN, of the same city,
Merchant; and THOMAS CAWTHRON, of the
same city, Commission Agent, for the benefit
of the Creditors of the said Israel Johns and
Thomas Trewheellar; according to the pro-
visions of the "Debtors and Creditors Act,
1862;" unless, as to so much of this Order
as vests the Estate and Effects of the said
Israel Johns and Thomas Trewheellar in the
said John Beit, Joseph Henry Levien, and
Thomas Cawthron, cause to the contrary be
shown at Wellington, before the 20th day of
March now next ensuing.
