days, they shall prove, to the satisfaction of the arbitrators, that their absence was unavoidable and occasioned through stress of weather or some like cause, their claim shall be considered still good.

That in all cases of dispute the burthen of proof shall rest with the party or parties that may jump the claim.

In the event of any party possessing a claim behind one having frontage to the water, the front claimants shall allow the party working behind them a passage through their claim to obtain water to wash their stuff with, so long as there is no impediment placed in the way of working the front claim; and in the same manner, the party working the hind claim may be permitted to convey his wash stuff across the front claim for the purpose of washing it, provided always that there are no tailings left to the impediment of the front claim.

All disputes whatever shall be settled by twelve diggers, the majority of whose decision shall be final; and each disputant shall have the privilege of challenging three out of the twelve arbitrators first chosen.

That parties discovering gold on any other river, or tributary of a river, other than the Wakamarina, shall be entitled to a prospecting claim.

Resolved that Cleyne’s party shall be allowed to hold an extra claim, in consideration of their services rendered in developing the field, and that they should be allowed first choice in pegging out their claim.

Unanimously agreed that the foregoing Rules and Regulations shall be observed generally, and that they shall be printed and circulated generally among the diggers, the cost of printing to be defrayed by the Provincial Government of Marlborough.
