BYE-LAW No. V.
PEDLERS AND HAWKERS.
A Bye-Law of the Council of the Borough of Timaru made under “The Municipal Corporations Act, 1867.”
In pursuance of the 181st section of “The Municipal Corporations Act, 1867,” the Council of the Borough of Timaru ordain as follows:—
“The provisions contained in the fourth subdivision of the tenth part of the thirteenth Schedule of the said Act are hereby adopted in and for the said Borough.”
Passed by the said Council this Thirty-first day of May, in the year of our Lord one thousand eight hundred and seventy-two.

REGULATION No. IX.
LICENSING PEDLERS, HAWKERS, &c.
A Regulation of the Council of the Borough of Timaru made under the 88th provision of the fourth subdivision of the tenth part of the 13th Schedule to “The Municipal Corporations Act, 1867.”
In pursuance of section 192, part 13, of “The Municipal Corporations Act, 1867,” the Council of the Borough of Timaru make the following Regulations, that is to say—

No person shall carry on the trade or business of a Hawker or Pedler, or shall sell or expose for sale in any street or public place within the Borough of Timaru any article or thing without first having obtained from the Town Clerk a License in the form or to the effect contained in Schedule C to this Regulation, and paid the fees hereby made payable thereon.

Licenses to be issued under this Regulation shall be in the form or to the effect contained in Schedule C hereto, and shall be in force for the time or times respectively mentioned in such License or Licenses, which may be renewed from time to time on application at the Town Clerk’s office, and there shall be paid to the Town Clerk for every such License or renewal thereof the several sums of money specified in Schedule A to this Regulation, or such other sum or sums of money as may from time to time be fixed or appointed by any Resolution of the Council, and such Licenses or renewals shall be signed by the Town Clerk, and numbered in such order as shall be determined by the Council. Provided always that Licenses issued under this Regulation shall entitle the License holder to vend or hawk articles or goods about the streets of the said Borough, subject to the several Rules and Regulations made or from time to time to be made in that behalf.

Before any such License shall be granted, the person or persons applying for the same shall deliver at the Town Clerk’s office an application, in writing, stating the particulars, and pursuant to the form contained in Schedule B to this Regulation, and shall deposit with the Town Clerk such sum or sums of money for such License as are specified in Schedule A hereto. Provided always that it shall be lawful for the Council to refuse to grant such License if in the opinion of the majority of the Council it shall appear that the applicant is not of good character or that such License is not required.
Passed by the said Council this Twelfth day of August, in the year of our Lord one thousand eight hundred and seventy-two.
