THIS DEED made the Seventeenth day
of April one thousand eight hundred and seventy-one between James Jones of
Christchurch in the Province of Canterbury New Zealand Gentleman of the first
part Patrick Fitzgibbon of Rolleston in
the said Province Farmer of the second
part and William Rolleston Esquire Superintendant of the said Province of the third
part Whereas by deed bearing date the
Twenty-ninth day of June one thousand
eight hundred and seventy and made be-
tween the said Patrick Fitzgibbon of the
one part and the said James Jones of the
other part rural section 7684 in the said
Province was conveyed and assured unto
the said James Jones by way of mortgage
to secure the repayment of a sum of money
with interest thereon at the times and in
manner therein mentioned And whereas
the said Patrick Fitzgibbon has agreed with
the said William Rolleston as such Superintendant for the conveyance to him of the
parcel of land hereinafter described in exchange for twenty-five acres three roods ten
perches of Crown Land and hath applied to
the said James Jones to join in these presents for the purpose of more effectually
conveying the same which he hath agreed to
do (testified by his being a party hereto)
Now this Deed witnesseth that in consideration of twenty-five acres three roods ten
perches of Crown Land of the value of
Fifty-one pounds twelve shillings and sixpence granted to the said Patrick Fitzgibbon with the consent of the said James
Jones at the execution of these presents the
said James Jones doth hereby convey and assure unto the said William Rolleston and
the said Patrick Fitzgibbon doth hereby
convey and assure ratify and confirm unto
the said William Rolleston and his successors Superintendents of the said Province
All that parcel of land one chain wide being part of said rural section 7684 containing
by admeasurement two acres three roods
thirty-six perches more or less commencing at the north-east corner of section 5690
thence northerly following the western
boundary of section 4962 a distance of five
chains thirty links to the north-western
corner thereof thence again northerly following a straight line to a point on the
northern boundary of the aforesaid section
7684 situate thirty chains twenty-five links
from its north-east corner thence westerly
following the said northern boundary a distance of one chain thence southerly following lines parallel to and one chain distant
from the eastern boundary before described
to the north boundary of section 5690 before
mentioned and from thence returning along
the same to the commencing point as shown
on the plan hereon and herein coloured
Pink together with the appurtenances to
hold the same unto the said William Rolleston and his successors Superintendents of
the said Province for ever for the purposes of a Public Road freed and discharged
from the before in part recited deed of
mortgage and all claims thereunder whether legal or equitable In witness whereof the
said parties to these presents have hereunto set their hands the day and year first
above written.\n
