Municipal Building Regulations




  1. That the external and party walls of every new building to be erected within one hundred feet of the road frontage on any section of land within the portion of the Borough of Timaru described in Schedule A to this Regulation shall be constructed of brick, stone or other incombustible material, and that the height and thickness of the external and party walls of such new building to be erected as aforesaid shall be regulated by the Rules specified in Schedule B to this Regulation, and the foundation of such building shall rest on the solid ground or on concrete, asphalt, or other solid substance, and that the flat, gutter and roof of the same and every turret, dormer, or other erection placed on the flat or roof thereof (except the windows and window frames of the same) shall be covered externally with slates, tiles, metal, or other incombustible material, and every chimney to such building shall be constructed of brick or stone, and the flues of the same properly parged, provided that all outbuildings for the use of such new buildings may be constructed of any material, but such outbuilding shall not be erected (unless wholly constructed of incombustible materials) within one hundred feet of the said road frontage, provided also that the roof of all such outbuildings shall be covered with slates, tiles, metal, or other incombustible material, and that no fire be allowed within such outbuildings unless wholly constructed of incombustible materials.

  2. That the roof, flat, gutter, and every turret, dormer, or other erection placed on the flat or roof of every new building to be erected within the portion of the Borough of Timaru described in Schedule C to this Regulation shall (except the windows and window frames of the same) be covered with slates, tiles, metal, or other incombustible material, and if the external and party walls of such new building shall be constructed of timber the same walls shall be filled in with earth or clay, and that every chimney erected within any portion of the Borough of Timaru shall be constructed of brick or stone, and the flues of the same properly parged.

  3. That no chimney or stack for the use of any foundry, manufactory, brewery, mill, gaswork, or other such like purpose, shall be constructed or built within any portion of the Borough of Timaru, without the consent in writing of the Council first had and obtained.

  4. That for the purposes of this Regulation every new building to be erected as aforesaid shall be subject to the superintendence and inspection of the Engineer to the Council for the time being and the owner or owners of every new building shall be required to pay to the Borough Fund such fees as are specified in Schedule D to this Regulation for such inspection or superintendence performed under this Regulation by the Engineer or Surveyor to the Council.

  5. That all wooden buildings heretofore erected within the portion of the Borough of Timaru described in Schedule A to this Regulation may be repaired outwardly with the same material with which such buildings are constructed, subject to the approval of the Engineer or Surveyor to the Council for the time being, also that such wooden buildings shall at the expiration of fourteen years after this Regulation shall come into force, upon order of the Council, be taken down and removed.

  6. The Regulation No. 5, intituled "Regulations as to Buildings, &c." is hereby repealed.

All Town Sections within the Borough of Timaru, as set out and numbered on the private plan of the Messrs. Rhodes, being part of Rural Sections No. 8 and 730, respectively, on the Map of the Chief Surveyor of the Province of Canterbury, setting out and describing the rural lands in the Timaru District, and all town sections set out and numbered on the Map of the Chief Surveyor of the said Province, setting out and describing the Government Town of Timaru, fronting upon either side of the following portions of the streets hereinafter named :-
