Debtors' and Creditors' Court Orders




IN THE SUPREME COURT OF NEW ZEALAND,
CANTERBURY DISTRICT.

In the matter of "The Debtors’ and Creditors’ Act, 1862;" and

In the matter of the Petition of William Joynt and Nathaniel Niel Joynt, of Christchurch, in the Province of Canterbury, Auctioneers, trading under the style or firm of "W. and N. Joynt," debtors, not in custody.

This 18th day of November, 1864.

UPON the application of Mr. Moorhouse of Counsel for the said petitioners, William Joynt and Nathaniel Niel Joynt, after reading the said petition, purporting to be signed by the said petitioners, such debtors as aforesaid, and to be concurred in by Thomas Ingham Joynt, of Christchurch aforesaid, solicitor, a creditor to the extent of not less than fifty pounds sterling in the whole, and also certain schedules, and also an affidavit of the said William Joynt and Nathaniel Niel Joynt to the said petition annexed, and therewith filed, the Sixteenth day of November instant, pursuant to the said Act, this Court, being satisfied of the truth of the matters contained in the said petition, doth hereby grant an ad interim order of sequestration of the estate and effects of the said William Joynt and Nathaniel Niel Joynt; and doth direct that the estate and effects of the said William Joynt and Nathaniel Niel Joynt be taken and held by Henry Fowle Seager, of Christchurch aforesaid, printer, and Receiver under the said Act, hereby appointed by the Court, subject to such further order of the Court as may be made under or in pursuance of the said Act: And the Court doth hereby appoint Wednesday, the Fifteenth day of February next, at eleven o’clock in the forenoon, for the hearing of such petition and the proof of debts and claims of creditors, at the Court House, Christchurch aforesaid: And this Court doth also further order and grant an ad interim order of protection to protect the persons and estates of the said William Joynt and Nathaniel Niel Joynt from arrest and execution, or other legal process until further orders of this Court.

This 18th day of November, 1864.

UPON the application of Mr. Moorhouse of Counsel for the said petitioner, Thomas Brown Craig, after reading the said petition, purporting to be signed by the said petitioner, such debtor as aforesaid, and to be concurred in by Urquhart Macpherson, of Lyttelton, in the said Province, Merchant, a creditor to the extent of not less than fifty pounds sterling in the whole, and also certain schedules, and also an affidavit of the said Thomas Brown Craig to the said petition annexed, and therewith filed, the Twelfth day of November instant, pursuant to the said Act, this Court, being satisfied of the truth of the matters contained in the petition, doth hereby grant an ad interim order of protection to protect the person and estate of the said Thomas Brown Craig from arrest, execution, or other legal process until further order of the Court.

IN CHAMBERS :

This 18th day of November, 1864.

UPON the application of Mr. Moorhouse of Counsel for the said petitioner, David Salomon, after reading the said petition, purporting to be signed by the said petitioner, such debtor as aforesaid, and to be concurred in by Henry Salomon, of Timaru, in the Province aforesaid, Draper, a creditor to the extent of not less than fifty pounds sterling in the whole, and also certain schedules, and also an affidavit of the said David Salomon to the said petition annexed, and therewith filed, the Twelfth day of November instant, pursuant to the said Act, this Court, being satisfied of the truth of the matters contained in the said petition, doth hereby grant an ad interim order of sequestration of the estate and effects of the said David Salomon, and doth direct that the estate and effects of the said David Salomon be taken and held by Henry Fowle Seager, of Christchurch aforesaid, printer, as Receiver under the said Act, hereby appointed by the Court, subject to such further order of the Court as may be made under or in pursuance of the provisions of the said Act: And this Court doth hereby appoint Wednesday, the Fifteenth day of February next, at eleven o’clock in the forenoon, for the hearing of such petition and the proof of debts and claims of creditors, at the Court House, Christchurch aforesaid: And the Court doth also further order and grant an ad interim order of protection to protect the person and estate of the said David Salomon from arrest and execution, or other legal process until further order of the Court.
