In the matter of “The Debtors’ and Creditors’ Act, 1862.”

NOTICE is hereby given that the following Petitions will be heard in the Supreme Court, on Tuesday, the Fifteenth day of August next, at eleven o’clock in the forenoon, at the Court House, Christchurch :—

In the matter of CHRISTOPHER PERCY SOULSBY, of Christchurch, in the Province of Canterbury, lately a Clerk to the Waste Lands Board of the said Province, but now out of employment.

In the matter of ALFRED PORTER, formerly of Porter’s Pass, Otarama Station, in the Province of Canterbury, Runholder, but now of Kaiapoi, in the said Province aforesaid, Farmer.

In the matter of WILLIAM HENRY WHITING, of the Lincoln Road, in the Province of Canterbury, formerly Toll Keeper, but now of the Lincoln Road aforesaid, Labourer.

NOTICE is hereby given that the estates of the undermentioned persons were sequestrated by the several orders of His Honor Mr. Justice Gresson, made respectively on the Fourteenth day of July, 1865, on petitions filed in this Honorable Court in pursuance of the above-named Act, and Tuesday the Fifteenth day of August next, at eleven o’clock in the forenoon, has been appointed for the hearing of the matters of such petitions at the Court House, Christchurch :—

ALEXANDER HERON, of Lyttelton, in the said District, Storekeeper, a debtor.

ROBERT ROSS, of Christchurch, in the said District, lately stock-buyer and salesman to Messrs Aikman & Wilson, of Christchurch aforesaid, Commission Agents, now out of business.

In the matter of the Estate of Henry Kite, of Kaiapoi, in the Province of Canterbury, Wheelwright, a debtor, not in custody; and

In the matter of the Petition of the said debtor.

IN CHAMBERS :

This 14th day of July, 1865.

UPON the application of Mr. Travers of Counsel for the said petitioner, Henry Kite, after reading the said petition purporting to be signed by the said petitioner, such debtor as aforesaid, and to be concurred in by Messrs. Thomas and Edward Pavitt, of Christchurch, Timber Merchants, co-partners, creditors to the extent of not less than fifty pounds in the whole, and also certain schedules, and also an affidavit of the said petition annexed, and therewith filed on the Eleventh day of July instant, pursuant to the said Act, this Court, being satisfied of the truth of the matters contained in the said petition, doth hereby grant an ad interim order of sequestration of the estate and effects of the said Henry Kite; and doth direct that the estate and effects of the said Henry Kite shall be taken and held by Henry Fowle Seager, of Christchurch, printer, as Receiver under the said Act, hereby appointed by the Court, subject to such further order of the Court as may be made under or in pursuance of the provisions of this Act: And this Court doth hereby appoint Tuesday, the Fifteenth day of August next, at eleven o’clock in the forenoon, for the hearing of such petition and the proofs of debts and claims of creditors, at the Court House, Christchurch aforesaid: And the Court doth also further order and grant an ad interim order of protection to protect the person and estate of the said Henry Kite from arrest, execution, or legal process until further order of this Court.

In the matter of the petition of William Henry Whiting of the Lincoln road in the Province of Canterbury formerly toll-keeper but now of the Lincoln road aforesaid labourer a debtor not in custody.

This fourteenth day of July 1865.

UPON application of Mr. Bamford of Counsel for the said petitioner William Henry Whiting after reading the said petition purporting to be signed by the said petitioner such debtor as aforesaid and to be concurred in by John Griffiths of the Lincoln road aforesaid labourer a creditor to the extent of not less than fifty pounds sterling in the whole and also certain schedules and also an affidavit of the said William
