than that aforesaid then the owner shall
forthwith return to such driver or conductor
the license belonging to him.
Licenses may be revoked cancelled or suspended.
- The license of any driver or conductor
or that of any hackney carriage may be revoked cancelled or suspended by the said
Council as they shall deem right after
notice given to such owner driver or conductor to show cause why the same should
not be revoked cancelled or suspended and
opportunity thereupon given to him to show
such cause.
Driver or Conductor must not lend or part with License. Owner must not allow unlicensed person to act &c.
- No driver or conductor of a licensed
carriage shall lend or part with his license
except as directed in clause 12 nor shall the
owner of any such carriage employ or permit
any unlicensed person to act as the driver or
conductor thereof and no person (whether
licensed or not) shall act as the driver or
conductor of any hackney carriage without
the consent of the owner thereof.
Carriage, &c., may be inspected.
- The said Council shall as often as it
may deem necessary cause an inspection to
be made of all licensed carriages and of the
harness and horse or horses used in drawing
the same and if any such carriage or horse
or harness shall at any time be found insufficient or unfit for public use the said Council may cause notice in writing in the form
or to the effect contained in the schedule
hereto annexed marked E to be given to the
owner of such carriage and after service of
such notice upon the owner driver or conductor of such carriage no such owner shall
use or let to hire such carriage or suffer the
same to be used or let until the same or the
harness or horse or horses used in drawing
the same as the case may require shall in the
opinion of the said Council or their officer
appointed for that purpose be in a fit condition for public use.
Number to be painted on carriage.
- The number of the license granted for
every such carriage in figures not less than
two inches in height and of proportionate
breadth white upon a ground of black shall
be painted outside on the panel of each door
of such carriage or on such other part or
parts of the said carriage or on a plate or
plates affixed thereon or in such other manner as the said Council may direct and such
number shall be kept conspicuous legible
and undefaced during all the time such carriage shall ply or be used for hire and shall
apply to and shall be painted or fixed upon
no other carriage than the one for which the
license to which it corresponds shall have
been granted provided that it shall be
lawful to transfer such number to a carriage
substituted for such licensed carriage by
permission of the said Council as hereinbefore provided for and during the period of
such permission and no longer.
Number to be printed on carriage.
- The said Council may when it thinks
fit order that the number of the license of
every licensed carriage on a card or plate six
inches by three inches printed or painted in
clear legible figures together with the number
of passengers which such carriage is
licensed to carry and the table of fares fixed
by the said Council shall be fixed at the
upper part of the front panel or in such
other place as the said Council may direct
inside of such carriage and such card or
plate shall be kept so affixed conspicuous
and undefaced during all the time the
carriage shall ply or be used for hire.
The authorised number of passengers must not be exceeded.
- The number of passengers to be conveyed in each licensed carriage of whatever
description the same may be shall be determined by the said Council upon the report
of their appointed officer and no greater
number of passengers than the number so
determined on shall at any one and the same
time be carried in such carriage on any pretence whatever provided always that each
passenger shall be entitled to a width on the
seat of not less than sixteen inches with full
and sufficient space in front of each seat.
Children how counted.
- No child under seven years of age
shall be counted as a passenger unless there
shall be more than one such child in which
case two of such children shall be considered
as one passenger and so on in respect of
every two such children provided that
infants in arms shall not be counted as passengers in any case.
Maximum rates and fares.
- The maximum fares chargeable for the
conveyance of passengers by the owners
drivers or conductors of any hackney carriage shall be as set forth in schedule F
hereof annexed and it shall be lawful for
the said Council to amend vary and alter
such rates and fares from time to time and
to fix and establish in lieu thereof such other
rates and fares as it may deem expedient
and such amended rates and fares shall be
notified in one or more newspaper published
in the said City of Christchurch and shall be
deemed the rates and fares which from and
after such notification may be lawfully demanded by any hackney carriage owner
driver or conductor such rates and fares to
be inclusive of all charges for luggage not
exceeding fourteen pounds weight.
Computation of distance.
- The distance for which any charge
shall be made shall be computed from the
stand or from the place where the carriage
was hired but back fares to be charged only
to the boundary of the city.
Distinction of vehicles as regards fares.
- For the purpose of regulating the
