annexed marked B or to the like effect and shall be in force from the date of each such license until the Thirty-first day of December next ensuing and no longer and no such license shall include more than one carriage provided that where the licensed carriage shall be under repair or for any other reason if the owner shall so desire he be permitted to substitute another carriage for a period to be specified by indorsement on the license and signed by the Town Clerk.
Cost of license.
- For every hackney carriage licensed there shall be paid to the Town Clerk the sum of Three Pounds annually if the license be granted on or after the First day of January and on or before the Thirtieth day of June in any year and if after that date the sum of One Pound Ten Shillings.
Driver and conductor to be licensed.
- No person shall act as the driver or conductor of any hackney carriage within the City of Christchurch or within the distance of eight miles from the corporate limits thereof unless he shall have a license granted and in force under the provisions of this by-law so to do.
Requisitions to be made for drivers’ and conductors’ licenses.
- Before a license be granted to any person as a hackney carriage driver or conductor a requisition for the same shall be made at the Office of the Town Clerk in the form contained in the schedule hereto annexed marked C or to the like effect and shall be signed by the applicant who shall further produce satisfactory certificates of good conduct and if a driver of ability to drive and any owner desirous of acting as driver or conductor of any licensed carriage must obtain a license in the same manner.
Form and costs of drivers’ and conductors’ licenses.
- The licenses of drivers and conductors of hackney carriages shall be in the form contained in the schedule hereto annexed marked D or to the like effect and shall be numbered in such manner as may be approved of by the said Council and for every such license there shall be paid the sum of Twenty Shillings to the Town Clerk provided that if the licenses be granted after the Thirtieth day of June in any year the sum of Ten Shillings shall be paid and such license to remain in force only until the Thirty-first day of December thence next ensuing and notice to renew such license shall be made on or before the Fifteenth day of December in each year upon which occasion the license previously issued shall be produced in order that the Council may consider the same before the expiration of the year.
Licenses how signed and numbered.
- All licenses granted under this by-law shall be signed by the Town Clerk and numbered in such order as may be determined by the said Council and all licenses to drivers and conductors shall be furnished in duplicate.
Owner must not part with his licensed carriage without permission of Council.
- No owner shall be at liberty to part with his licensed carriage nor with the license appertaining thereto to any person without the knowledge and approval of the said Council and the registry of the name of the purchaser shall be entered in the books of the Town Clerk and on the license granted for such carriage and any owner who shall part with his carriage without such approval and registry shall still be deemed the owner of such carriage and subject as fully as if no change of ownership had taken place and the purchaser of such carriage who shall allow the same to be used or to ply for hire without such approval and registry shall be subject to the same penalty as is imposed by this by-law on any person for plying without a license.
Owner must give notice of change of residence.
- Whenever any person named as the owner or one of the owners of a licensed hackney carriage shall change his place of abode he shall within two days next after any such change give notice thereof in writing signed by him to the Town Clerk specifying his new place of abode and shall at the same time produce his license to the Town Clerk who shall endorse thereon and sign a memorandum specifying the particulars of such change.
Owner to hold and produce driver’s and conductor’s license.
- Whenever the owner of any licensed carriage shall employ or permit any licensed person to act as driver or conductor thereof such owner shall require to be delivered to him and shall retain in his possession the license of such driver or conductor during such time he shall act or be employed as such and in all cases of complaint affecting such licensed driver or conductor the owner may be summoned to attend before a Justice of the Peace who shall be required to produce the license of such driver or conductor and if any driver or conductor complained of shall be adjudged guilty of the offence alleged against him it shall be lawful for the Justice to make an endorsement upon the license of such driver or conductor stating the nature of the offence and the amount of penalty inflicted.
License to be returned.
- When any driver or conductor shall leave the service of the owner by whom he has been employed for any misconduct in such service punishable under this by-law such owner shall forthwith deliver to the Town Clerk the license of such driver or conductor but if such driver or conductor shall leave such service for any other cause
