In the matter of the "Debtors' and Creditors' Act, 1862;" and
In the matter of the Estate of Francis Amy, of Christchurch, in the Province of Canterbury, in the Colony of New Zealand, General Smith and Contractor, a debtor, not in custody; and
In the matter of the petition of the said debtor.
In Chambers:
This Twenty-third day of August, 1864.
Upon the application of Mr. Oakes of Counsel for the said petitioner, Francis Amy, after reading the said petition purporting to be signed by the said petitioner, such debtor as aforesaid, and to be concurred in by Henry Joseph Hall, of Christchurch aforesaid, storekeeper, a creditor to the extent of not less than fifty pounds in the whole, and also certain schedules, and also an affidavit to the said petition annexed, and therewith filed on the Twenty-second day of August, pursuant to the said Act; this Court being satisfied of the truth of the matters contained in the said petition, doth hereby grant an ad interim order of sequestration of the estate and effects of the said Francis Amy; and doth direct that the estate and effects of the said Francis Amy shall be taken and held by Henry Fowle Seager, of Christchurch, printer, as Receiver under the said Act, hereby appointed by the Court, subject to such further order of the Court as may be made under or in pursuance of the provisions of this Act; and this Court doth hereby appoint the Fifteenth day of November next, at eleven o'clock in the forenoon, for the hearing of such petition and the proof of debts and claims of Creditors at the Court House, Christchurch, aforesaid; and this Court doth also further order and grant an ad interim order of protection to protect the person and estate of the said Francis Amy from arrest, execution, or legal process, until further orders of this Court.

Upon the application of Mr. Oakes of Counsel for the said petitioner Charles Phillips after reading the said petition, purporting to be signed by the said petitioner, such debtor as aforesaid, and to be concurred in by Alexander Matthews, of Christchurch aforesaid, grocer, a creditor to the extent of not less than fifty pounds in the whole, and also certain schedules, and also an affidavit to the said petition annexed, and therewith filed the twenty-eighth day of July pursuant to the said Act; this Court being satisfied of the truth of the matters contained in the said petition, doth hereby grant an ad interim order of sequestration of the estate and effects of the said Charles Phillips, and doth direct that the estate and effects of the said Charles Phillips shall be taken and held by Henry Fowle Seager, of Christchurch, printer, as Receiver under the said Act, hereby appointed by the Court, subject to such further order of the Court as may be made under or in pursuance of the provisions of this Act: and this Court doth hereby appoint Tuesday, the Fifteenth day of November next, at eleven o'clock in the forenoon, for the hearing of such petition and the proofs of debts and claims of creditors at the Court House, Christchurch, aforesaid; and the Court doth also further order and grant an ad interim order of protection to protect the person and estate of the said Charles Phillips from arrest, execution, or legal process, until further order of this Court.
