✨ Harbour and Water Regulations

Any master who shall make a signal for a pilot, or cause a pilot to be sent for to take his vessel to sea, and shall not within 12 hours of the time of arrival of the pilot on board such vessel, proceed to sea, shall pay a sum at the rate of One Pound per day, for every day such pilot may be detained on board such vessel, in addition to the regular pilotage.

Every pilot detained on board a vessel longer than forty-eight hours, whether by stress of weather, quarantine, or otherwise, is to be paid eight shillings per day, in addition to the regular pilotage.

Pilots refusing or neglecting their duty to forfeit a sum not exceeding fifty pounds.
WATERMEN’S REGULATIONS.

All carters, porters, and watermen engaged upon the public wharfs to be under the control of the Port Officer.

Any boatman carrying passengers for hire, without a license, to the shipping, shall be liable to a fine not exceeding five pounds.

Every waterman shall upon payment of One Pound per annum, in respect of every boat to be plied by him, receive a license to be renewed on the 1st July in each year.

No boat shall be allowed to remain at any landing place after discharging her cargo and passengers, or to make fast to any steps, or handrails belonging thereto, without some person in charge ready to remove the said boat when required to do so by the Port Officer, or person deputed by him.

A board exhibiting the authorized charges from sunrise to sunset, shall be placed near the landing-place; after sunset, and when the blue flag shall be hoisted half-mast by the Harbour Master, or person deputed by him, denoting bad weather, double fares can be demanded by the waterman.

Any boatman resisting, impeding, or obstructing the Harbour Master, Pilot, or other person deputed by either of them in the execution of his duty, or using threatening or abusive language to them, or any of them, shall forfeit and pay a sum not exceeding fifty pounds.

The number of passengers allowed to be carried as specified in each license shall be legibly painted on some conspicuous part of the boat in respect of which such license is issued, and should any boatman convey a larger number of passengers, or a greater quantity of luggage, than is allowed in his license, he shall forfeit and pay a sum not exceeding twenty pounds.

Each boat shall carry if required 8 lbs weight of luggage with every passenger, without additional charge, and any passenger detaining a boat alongside any vessel for a period exceeding twenty minutes, shall be liable to an extra charge at the rate of four shillings per hour.
BALLAST LIGHTERS.
- All ballast lighters, cargo and water tank boats plying for hire shall be measured, marked, and registered, and upon payment of three shillings per ton measurement shall receive a license to be renewed on the 1st July in each year.

Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by Warrants under the hand of his Excellency the Governor, bearing date this Fourteenth day of September, One thousand eight hundred and sixty-four, the Governor has, with the advice and consent of the Executive Council of New Zealand, delegated to the Superintendents respectively of the Provinces of Auckland, Taranaki, Wellington, Hawke’s Bay, Nelson, Marlborough, Canterbury, Otago and Southland, certain powers conferred on him by the “Diseased Cattle Act, 1861,” subject to certain Regulations to be made by the Governor in Council under the said recited Act:
Now, therefore, His Excellency the Governor, with the advice and consent of the Executive Council of New Zealand, by virtue of the authority given to him by the 14th Section of the above recited Act, doth hereby make and ordain the following Regulations:—

The delegation of powers under the said warrants shall continue to be in force for the period of one year from this date, subject to be rescinded according to the provisions of the above recited Act.
