Any Person found in a carriage or station, or upon the railway wharf or premises in a state of intoxication, or committing any nuisance, or wilfully interfering with the comfort of the Passengers, shall be liable to a penalty of five pounds, and shall immediately, or, if travelling, at the first opportunity, be expelled from the railway premises, and forfeit his fare ticket, of what kind soever such ticket may be.

Any Passenger cutting the linings, removing or defacing the number plates, breaking the windows, or otherwise wilfully damaging or injuring any carriage on the railway, shall be liable to a penalty of ten pounds, in addition to the amount of damage done.

No gratuity is, under any circumstances, allowed to be received by the Officials or Servants employed on this railway, on penalty of immediate dismissal.

Every Passenger, on arriving at the station for which he or she may have taken a ticket, or to or from which he or she may hold a periodical ticket, shall quit the station and premises of the railway, and no person shall be allowed to loiter about the station, wharf, or premises, or any part thereof; and if any Passenger or other person shall refuse to quit the station, wharf, or premises aforesaid, on being requested so to do by any Station Master or other Servant attached to the railway on wharf, such Passenger or person may be expelled by such Station Master or other Servant as aforesaid from the railway premises, and, in addition thereto, shall be liable to a penalty of two pounds.

No Drayman, Carter, Porter, or other Person will be allowed to come into or upon the railway premises for the purpose of removing luggage or goods, either with or without a dray or hand-cart or truck, unless required by a Passenger, and specifically engaged by him for the express purpose, and no person will be allowed to come into or upon the railway premises for the purpose of touting or soliciting custom for hotels or boarding-houses, or any custom or hire of any kind whatsoever; and any Drayman, Carter, Porter, or other Person evading or attempting to evade this regulation, or refusing or neglecting to quit the railway premises when thereto required by any Station Master or other Servant as aforesaid, shall be expelled from the railway premises, and, in addition thereto, shall be liable to a penalty of £10.

No gunpowder or other explosive or dangerous material shall be carried in any passenger train under a penalty of £20 for each offence.
MERCHANDIZE

All goods and merchandize, whether bonded or free, and all luggage having arrived at its destination, shall be removed from the platform and sheds within twelve working hours; and any free goods, merchandise, or luggage not removed by that time, may be stored at the risk and expense of the Consignees or Owners, and will then become subject to such charges as may from time to time be fixed by the Lessees of the railway; and any bonded goods or merchandize which shall not be removed within the period aforesaid shall be subject to the payment of the sum of 2s. per ton per day until the removal of the same from the railway premises.

Any goods, merchandize, or luggage arriving at any station other than the Christchurch terminus which shall not be removed from the railway premises within twelve working hours may be forwarded to Christchurch at the expense of the Consignee or Owners, and there stored at his risk and expense, and the same will then become subject to the charges mentioned or referred to in section 16.

All goods shall be forwarded within twenty-four working hours after arrival at any railway station.

Every vessel shall be removed by the Master thereof from the railway wharf immediately after written notice shall have been left on board by the person in charge of the wharf requiring the removal of such vessel, and any Master failing to remove his vessel within the period aforesaid shall be liable to a penalty of £20 per day for every day or fractional part of a day thereafter during which such vessel may occupy a berth at the said wharf.

The Master of any vessel arriving at the wharf shall cause the discharge thereof to be proceeded with beyond the usual working hours; that is to say—in the summer, from 6 o’clock in the morning until 6 o’clock in the evening, and in the winter, from 7 o’clock in the morning until 5 o’clock in the evening, if so required by the person in charge of the wharf.

The Lessees will not be answerable or accountable for any damage to goods or merchandise, nor for leakage, breakage, or rust, unless the same shall happen through the negligence of the Lessees or their Servants, nor in respect of any goods which shall have been improperly packed or addressed, nor for plate, china, glass, pictures, wearing apparel, or other valuables, whether of a like nature or otherwise, unless specially entered and paid for as valuable or hazardous goods.

No claim for loss will be allowed or recognized, unless the particulars of such claim be lodged with the Station Master at Christchurch within fourteen days after such loss shall have arisen; and no claim for damage will be allowed or recognized after the removal from the railway premises of the goods or merchandize alleged to have been damaged.
GENERAL
- The speed at which carriages shall be propelled on the railway shall not exceed the rate of 35 miles per hour.
The foregoing by-laws were approved at a meeting of His Honor the Superintendent and Executive Council, held at the Government Buildings, at Christchurch, on the 5th day of December, 1863.
