SIR,

I HAVE the honor to request that His Excellency will be pleased to proclaim the “Resident Magistrates’ Court Extension of Jurisdiction Ordinance,” to come into operation for the Courts at Lyttelton and Christchurch, to extend over the whole Province of Canterbury, and the Resident-Magistrate of Lyttelton to be the presiding Judge in both such Courts.

WITH reference to your Honor’s letter of the 9th October last, (No. 26,) requesting that the “Resident Magistrates’ Court Extension of Jurisdiction Act, 1856,” might be brought into operation at Lyttelton and Christchurch, I have the honor to transmit the accompanying “Government Gazette” of the 11th instant, containing a Proclamation by the Governor bringing the said Act into operation from and after the 31st proximo in respect of the Resident Magistrates’ Court at Lyttelton.

The above Court only has been proclaimed, it being unadvisable that two Courts should possess a concurrent jurisdiction, as from the wording of the Act the extended powers are conferred upon the Court, and not upon any particular Resident-Magistrate.

PROCLAMATION.

By his Excellency Colonel THOMAS GORE BROWNE, Companion of the Most Honorable Order of the Bath, Governor and Commander-in-Chief in and over Her Majesty’s Colony of New Zealand, and Vice-Admiral of the same, &c., &c., &c.

WHEREAS by an Act of the General Assembly of New Zealand, intituled “The Resident Magistrates’ Courts Extension of Jurisdiction Act, 1856,” it is enacted that it shall be lawful for the Governor, upon the request of the Superintendent of any Province, by Proclamation in the “Government Gazette,” to bring the said Act into operation in respect to any Resident Magistrate’s Court having jurisdiction within such Province from and after a certain day to be named in such Proclamation, and to define the districts within which cases may be heard in such Court under the provisions of this Act.

Now therefore, I, the Governor of New Zealand, upon the request of the Superintendent of the Province of Canterbury, do hereby Proclaim and Declare that the said recited Act shall come into operation, in respect of the Resident Magistrate’s Court of Lyttelton, in the said Province, from and after the thirty-first day of December, in the year 1856, and that the said Province of Canterbury shall be the district within which cases may be heard in such Court under the provisions of the said recited Act.

Given under my hand, and issued under the Public Seal of the Islands of New Zealand, at Auckland, in the Colony aforesaid this seventh day of November, in the year of our Lord One thousand eight hundred and fifty-six.
