PROCLAMATION.
By His Honour Sir George Grey, Knight,
Commander of the Most Honourable Order of the Bath, Superintendent of the Province of Auckland.
WHEREAS, by the eighth section of an Act of the General Assembly of New Zealand, entitled "The Gold Mining Districts Act, 1873," it is enacted that it shall be lawful for the Governor from time to time by proclamation in the General Government Gazette to constitute and appoint any District to be a Gold Mining District under the said Act; to assign boundaries to such district; to enlarge or otherwise alter such boundaries; and to declare by what local name every such district shall be designated. And whereas, by the ninth section of the said Gold Mining Districts Act, 1873, it is enacted that it shall be lawful for the Governor, in the proclamation by which a Gold Mining District may be constituted, and from time to time by proclamation subsequently issued, either by general or particular description, to exempt from occupation for mining purposes, or for water-races, dams, or reservoirs, or for machine, business, or residence sites any land within the boundaries of any Gold Mining District. And whereas, in accordance with the provisions of the one hundred and eightieth and the one hundred and ninety-first sections of the said Act, the powers thus vested in the Governor by virtue of the said eighth and ninth sections of the said Act have been duly delegated to the Superintendent of the Province of Auckland. And whereas, by proclamation dated the third day of March, One thousand eight hundred and seventy-five, the Honourable Daniel Pollen, in exercise of the powers delegated to him as in the said proclamation mentioned, appointed a certain block of land therein described to be a goldfield under the provisions of "The Goldfields Act, 1866." And whereas by another proclamation, dated the third day of March, 1875, reciting the last-mentioned proclamation, the said Daniel Pollen, in exercise of the powers aforesaid, did exempt from occupation for mining and other purposes therein mentioned all that piece or parcel of land situated at Te Kahakaha, within the said goldfield. And whereas by another proclamation dated the said third day of March, One thousand eight hundred and seventy-five, reciting the said first in part recited proclamation, the said Daniel Pollen, in further exercise of the said delegated powers, did exempt from occupation for mining and other purposes therein mentioned all that other piece or parcel of land situated at Karangahake, within the said goldfield. And whereas by another proclamation, dated the third day of March, One thousand eight hundred and seventy-five, reciting the said first in part recited proclamation, the said Daniel Pollen did exempt from occupation for mining and other purposes therein mentioned certain lands adjacent to the East Coast therein mentioned. And whereas by a proclamation dated the first day of January, One thousand eight hundred and seventy-six, and in exercise of the powers therein mentioned to be delegated to me, I did enlarge and extend the Thames Gold Mining District, so as to include beyond its present boundaries all the block of land constituted a goldfield by the firstly hereinbefore recited proclamation, but excepting out of the said lands those several lands which, by the hereinbefore secondly, thirdly, and fourthly in part recited proclamations, were so exempted from occupation as aforesaid.
Now I, Sir George Grey, as such Superintendent, in exercise of the powers delegated to me as aforesaid, do hereby further enlarge and extend the said Hauraki Gold Mining District, so as to include in its present boundaries the several lands mentioned in the several proclamations hereinbefore secondly, thirdly, and fourthly in part recited. But I, the said Sir George Grey, do hereby exempt from such inclusion the several pieces of land exempted from occupation in the said hereinbefore recited proclamations.
