Sir,
I have the honour to acknowledge the receipt at Grahamstown, at 11.45 a.m. on the 25th instant, of the copy of the agreement with the natives for the cession of the Ohinemuri Goldfield.

In compliance with your wish expressed in your telegram of the same date, I beg to say that I never asked you for a copy of the Ohinemuri agreement before you left Auckland for the South. I had no knowledge that the agreement was in your possession, and that you were not yet furnishing me with a copy of an important document which I think should have been supplied to me immediately I became the Government’s delegate, even if it had not been previously supplied to my predecessor in the office of Superintendent, Mr. O’Rorke.

Referring to your Honour’s memo. quoting clause 5 of the deed of cession of Ohinemuri, I beg to suggest a reference to section forty of “The Goldfields Act, 1866,” which appears to impose certain preliminary steps which, so far as I know, have not yet been gone through. Have I any power to act pending compliance with said section? Consider also section fifty-two as to the acquiring fees simple.

On May 17th Sir D. McLean acquainted me for the first time that agricultural leases were included in the Ohinemuri Goldfield Agreement, and undertook that a copy of that Agreement should be supplied without delay. It was not supplied to me until 11.45 on Friday, the 25th June. The Provincial Council, which met on the 10th of May, adjourned on the 28th of May. By Goldfields Act, 1866, clause 40, the Governor can only proclaim agricultural leases in a goldfield upon application from Superintendent and Provincial Council. The Provincial Council cannot now conveniently meet before General Assembly. Will the General Government, under these circumstances, introduce into General Assembly, immediately it meets, a Bill to amend clause 40 in Goldfields Act of 1866, to enable Government at once to issue agricultural leases at Ohinemuri?

Re agricultural leases, Ohinemuri.—The Government will be prepared, if necessary, to bring a Bill to meet the difficulty caused by the failure of the Superintendent and Provincial Council of Auckland to make application to the Governor to bring the sections of “The Goldfields Act, 1866,” relating to agricultural leases into operation within the province, or will bring in a Bill to validate any leases which your Honour may in the meantime, with the advice and consent of your Executive Council, find it necessary to grant in the Ohinemuri Goldfield. The latter would probably be the more constitutional course, and as such may commend itself to your Honour.

I send you copies of two telegrams relating to agricultural leases. I have now resolved to approve of all such agricultural leases on the Ohinemuri block as you may recommend. If you require regulations in this matter to be issued send me your recommendations. Mr. Mackay has received some applications for leases; he should forward them to you.

Albert Dornwell, of Auckland,

for the renewal of the Private Slaughterhouse License granted to his premises, situated near the Three Kings, being part of allotments Nos. 7 and 9, section 13.
