Delegation of certain of the Governor’s Powers under "The Gold Mining Districts Act," 1873, to the Superintendent of the Province of Auckland.

ORDER IN COUNCIL.
At Christchurch, this eleventh day of December, 1873.
Present:
THE HONORABLE THE PREMIER, PRESIDING.
WHEREAS by "The Gold Mining Districts Act, 1873," it is among other things enacted that:
It shall be lawful for the Governor in Council, under his hand and the Public Seal of the Colony, from time to time to delegate to such person as the Governor in Council may deem fit, all or any of the powers vested in the Governor by the said Act, except the powers conferred by sections one hundred and thirty-six and one hundred and thirty-seven, and sub-section thirteen of section one hundred and sixty-five thereof, subject or not to any limitations or restrictions, and in like manner to alter or revoke any such delegation; And whereas it is expedient that the Governor should delegate to the person hereinafter named the powers herein mentioned and set forth:
Now, therefore, I, Sir James Fergusson, Baronet, the Governor of the Colony of New Zealand, in pursuance and exercise of the powers and authority in me vested by the said Act, and by and with the advice and consent of the Executive Council of the said Colony, do, by this order under my hand and the Public Seal of the Colony, hereby delegate unto
John Williamson, Esq.,
Superintendent of the Province of Auckland, all the powers vested in me under or by virtue of the said Act, except the powers conferred by sections one hundred and thirty-six and one hundred and thirty-seven, and sub-section thirteen of section one hundred and sixty-five, thereof, to have, hold, and exercise within the Province of Auckland the said powers hereby given to the said John Williamson, so long as he shall be and remain Superintendent of the said Province, and no longer: Provided that no Proclamation affecting any lands shall be made by the said John Williamson, under the powers hereby delegated to him, unless the Governor shall have obtained power to authorise entry on such lands for mining for gold, in the manner required by the said Act.

WHEREAS by "The Gold Fields Act Amendment Act, 1868," it is enacted that it shall be lawful for the Governor in Council, from time to time, by Proclamation issued under the third section of "The Gold Fields Act, 1866," to include such land within any Gold Field, or to proclaim such land a Gold Field: And by the said Act it is further enacted that it shall be lawful for the Governor in Council, under his hand and the Public Seal of the Colony, from time to time to delegate to the Superintendent of any Province, or to such other person as the Governor may deem fit, all or any of the powers vested in the Governor by the preceding sections of the said Act (including the above-recited section), subject or not to any limitations or restrictions as the Governor may think fit:
Now therefore, His Excellency Sir James Fergusson, Baronet, the Governor of New Zealand, with the advice and consent of the Executive Council of the Colony, in pursuance and exercise of the power for that purpose vested in him by the said Act, doth hereby delegate to
John Williamson, Esq.,
Superintendent of the Province of Auckland, all the powers vested in the Governor by the said recited section of "The Gold Fields Act Amendment Act, 1868," to have, hold, and exercise, within the Province of Auckland the said powers hereby delegated to the said John Williamson, so long as he shall continue and remain Superintendent of the said Province, and no longer: Provided always that no Proclamation affecting any lands shall be made by the said John Williamson, under the powers hereby delegated to him, unless the Governor shall have obtained power to authorise entry on such lands for mining for gold, in the manner required by the said Act.

THE HONORABLE THE PREMIER, PRESIDING.
WHEREAS by "The Lunatics Act, 1868," it is enacted that it shall be lawful for the Governor in Council, from time to time, to order and direct that all or any of the powers, functions, duties, and authorities vested in or required to be performed by the Governor or the Governor in Council, or the Colonial Secretary, by the said Act, within any Province or other district of the Colony, shall be exercised or performed by the Superintendent of any such Province, or by any other person the Governor, may think fit; and thereupon such functions, powers, duties, and authorities may by such Superintendent or other person be exercised or performed within the Province or other district of the Colony specified:
Now therefore, His Excellency Sir James Fergusson, the Governor of New Zealand, with the advice and consent of the Executive Council of the said Colony, in pursuance and in exercise of the power and authority for that purpose vested in him, doth hereby order and direct that all the powers, functions, duties, and authorities vested in or required to be performed by the Governor, or the Governor in Council, or the Colonial Secretary, by
