VICTORIA, by the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith: To Thomas Lindsay Macky, of the City of Auckland, in the Colony of New Zealand, Merchant, and Eliza Martin, wife of Francis Martin, late of the Papakura Hotel, in the Village of Papakura, in the Colony aforesaid, Innkeeper:

GREETING:

WHEREAS an action is now pending in our Supreme Court, Northern District, Province of Auckland, between William Alfred Ricketts Ryan and William Thomas James Bell, of the City of Auckland, in the Province of Auckland and Colony of New Zealand, Wine and Spirit Merchants, carrying on business under the style or firm of β€œRyan, Bell & Co.,” Plaintiffs, and Francis Martin, Publican, formerly of the Village of Papakura, in the Province aforesaid, but now in parts beyond the seas, Defendant, and in order that the Plaintiffs may proceed in the said action we command you that you and each of you do retain and keep all and singular lands and other hereditaments, moneys and chattels, bills, bonds, and other property of whatsoever nature, in the custody, or under the control of you or either of you at the time of the service of this writ, belonging to the above-named Defendant, or to or in which such Defendant shall at that time be legally or equitably entitled, or otherwise beneficially interested, and whether solely or jointly with any other person or persons, and all debts of every kind then due by you or either of you to such Defendant, although the same or part thereof may be payable only at a future day.

If you or either of you part with any of the Defendant's property, or pay him any debts due to him, you will become personally responsible to the Plaintiffs.
