not have been in lawful occupation of the land previously to the marking out of the same as aforesaid, shall enter upon, occupy, or in any way interfere therewith, until or unless this application shall be refused, he will be deemed to be a trespasser, and may be proceeded against in the Warden’s Court, under the 108th Section of "The Gold Fields Act, 1866."
