✨ Goldfield Lease Regulations
(4.) That the lessor may lay out and construct roads, railways, and tramroads on or over the demised land for the use of any person or company, or for the use of the public.
(5.) That he may grant by writing, under his hand, the right of entering on the demised land for the purpose of constructing and maintaining water races and tail races, and of leading head water and tail water through or over the same.
Lessee to be compensated for damage.
- Provided that as little damage as possible be done and inconvenience caused to the lessee by any such work as in subsections 4 and 5 of section 35, and in subsections 4 and 5 of section 38, mentioned, and that before any such work be commenced the estimated amount of damage to be done be paid to the lessee by the lessor, as he shall direct, and in case of dispute as to such compensation the same shall be assessed by the Warden, whose decision shall be final.
Rivers, &c., may not be diverted.
- The granting of any lease shall not authorise the diversion of any river stream or watercourse required for public purposes, or for the use of miners generally, or authorize the use of any water therefrom, or from any natural spring except for domestic purposes, but all such water on any demised land shall be subject to the Gold Field Regulations for the time being in force for regulating the granting of water rights.
Provision for Applications made before publication of these Regulations.
- In respect of applications for leases made before the publication of these Regulations in the Provincial Government Gazette, the Superintendent will act as near as conveniently can be in accordance with these Regulations, and all leases granted will be made in strict conformity therewith.

In pursuance of the Regulations for granting Leases for Gold Mining purposes, or for Sites for Machinery on Gold Fields, in the Province of Auckland, I hereby make application for a Lease, whereof the particulars are as follows, to be granted to [me, or to Robert Burns' Gold Mining Company, Registered.]
