PROCLAMATION.

Superintendent of the Province of Auckland, in the
Colony of New Zealand.
WHEREAS an infectious disease known
as Pleuro-Pneumonia has broken out
amongst the cattle in the Province of Auckland, and it is desirable to check the spread
of such disease.
And whereas by a warrant under the hand
of His Excellency the Governor, bearing date
the fourteenth day of September, 1864, the
said Governor, with the advice and consent of
the Executive Council, delegated to the Superintendent of the Province of Auckland,
certain powers conferred upon him by the
“Diseased Cattle Act, 1861,” subject to certain regulations to be made by the Governor
in Council under the said recited Act.
Now, therefore, I, Robert Graham, Esquire,
Superintendent of the Province of Auckland,
in pursuance of such delegation hereby revoke
the Proclamation issued by me upon the 20th
day of August, 1864, in so far as it defines
the limits of the Infected Districts, and I do
hereby proclaim and declare that from and
after the day of the date hereof, that part
only of the Province of Auckland, lying
South of a straight line running West from
the South Head of Wangarei Harbour, to
the West Coast, shall be and be deemed to be
an Infected District, within the meaning of
the “Diseased Cattle Act, 1861.” And in
further pursuance of such delegations, I, the
said Superintendent, do hereby make and
ordain the following regulation, which shall
be in force in the said district of the Province
of Auckland.
REGULATIONS.

The said proclaimed district shall, for
the purposes of the said Act, be called and
known as the “Auckland District.” -
Any person who shall knowingly or
wilfully drive over or along any road or highway cattle which may be infected with any
infectious or contagious disease, shall be liable
to a penalty not exceeding £200. -
Any person who shall knowingly keep
in his possession or on his premises any cattle
so infected, and shall not give notice to some
Inspector appointed under the said Act, shall
forfeit and pay any sum not exceeding £200. -
It shall be lawful for any Inspector appointed under the said Act to enter upon all
or any lands in any district which may have
been declared to be an infected district in
pursuance of the said Act, for the purpose of
inspecting any cattle which may be on such
lands; and if any such Inspector shall find
any cattle on such lands infected as aforesaid,
it shall be lawful for him to give notice thereof
to the owner of any such cattle, or the person
having charge of the same, or the occupier of
the lands on which such cattle may be running or depasturing, and shall at the same
time require any of such persons to forthwith
destroy any such cattle, and to bury or burn
the carcasses thereof to the satisfaction of such
Inspector. And if any person being thereto
lawfully required shall refuse to carry out
such direction or requisition, or shall neglect
to do so within a reasonable time after being
so required, he shall forfeit and pay any
penalty not exceeding £200. -
If any person shall refuse or neglect to
kill or bury any such cattle as aforesaid, it
shall be lawful for any Inspector duly
appointed under the said Act to take such
steps as to him shall seem fit for destroying
such cattle, and burying the carcasses thereof,
and all costs, charges, and expenses incurred
by any such Inspector in killing or burying
any such cattle shall be paid by the person
so neglecting or refusing to kill or bury such
cattle, and shall be recovered in addition and
by the same means as any penalty inflicted
by the said Act; Provided that such penalty,
together with such costs, charges, and expenses, shall not exceed in the whole the sum
of £200. -
It shall be lawful for any Inspector appointed under the said Act to take such steps
as to him shall seem fit for destroying all
cattle which may be infected as aforesaid,
wherever such cattle may be found, and
without giving such notice as aforesaid, and
to take the necessary steps for burying or
burning the carcasses of any such cattle
wherever the same may be destroyed. -
It shall be lawful for any such Inspector
as aforesaid to kill or cause to be killed any
cattle which he may have reason to suspect
are infected as aforesaid. -
It shall be lawful for any such Inspector
to inspect all or any public Slaughter Houses
or other places where cattle are or may be
slaughtered, for the purpose of examining
the carcasses of cattle there slaughtered; and
if it shall appear to such Inspector that any
carcasses are the carcasses of cattle infected
as aforesaid, he shall cause such carcasses to
be forthwith burned or buried. -
No person in the District of Auckland,
proclaimed as aforesaid, shall permit or suffer
the carcasses of any cattle infected or other-
wise, to remain unburied or unburnt on his
premises, or on any land in his occupation,
for a longer period than 12 hours, and any
person offending against this Regulation shall
forfeit and pay any penalty not exceeding
£50: Provided that this regulation shall not
extend to cases of cattle slaughtered for the
purposes of human food. -
Any person who shall wilfully obstruct,
impede, or interfere with any Inspector in the
lawful discharge of his duty, shall be liable
to a penalty not exceeding £200. -
No person shall drive, or permit to be
driven, or transport, or remove any cattle
