ROAD ACT, No. 1860.

IN THE TWENTY FOURTH YEAR OF THE REIGN OF HER MAJESTY QUEEN VICTORIA.

Preamble.

  1. Road in Schedule A to be closed.
  2. Land may granted to James Wooley.
  3. Land described in Schedule B to be opened as a Road.
  4. Superintendent may pay compensation.
  5. Short Title.

An Act to close up a certain Road in the Parish of Wangaririe, in the County of Marsden, in the Province of Auckland, and to authorize the Governor to grant the Land occupied by the said Road to James Wooley and to open a new line of Road over certain other Lands in the said Parish, the property of the said James Wooley.

Whereas it is expedient to close up the Road mentioned and described in the Schedule A to this Act annexed, and to open a new Road in lieu thereof, over the Land described in Schedule B to this Act annexed: And whereas the said Road so to be closed up as aforesaid passes through certain Lands the property of James Wooley: And whereas the Land mentioned and described in the said Schedule B is the property of the said James Wooley,
Be it therefore enacted by the Superintendent of the Province of Auckland, by and with the advice and consent of the Provincial Council thereof, as follows:

  1. From and after the passing of this Act the said Road mentioned and described in the Schedule A to this Act annexed, shall be closed.

  2. It shall be lawful for His Excellency the Governor of New Zealand to grant the land occupied by the said Road to the said James Wooley, his heirs and assigns, in fee simple.

  3. From and after the passing of this Act, the land mentioned and described in Schedule B to this Act, shall be opened as a new line of Road, and the same shall for ever thereafter be used as, and be, a public Highway.

  4. It shall be lawful for the said Superintendent from and out of the Public Revenue of the Province of Auckland, to pay to the said James Wooley, his heirs, or assigns, such compensation as may be awarded under the provisions of the “Diversion of Roads Act, 1858.”

  5. The Short Title of this Act shall be “The Road Act, No. 1860.”

SCHEDULE A.

That portion of the Road from Wangaririe to Ngunguru commencing at a point within the boundary of a parcel of land being a subdivision of lot 2 of the Parish of Wangaririe, County of Marsden, and known as James Wooley’s property, 700 links or thereabouts from a stream forming the southern boundary of the said James Wooley’s property, and proceeding thence in a northerly direction through the property of the said James Wooley and terminating on the Ngunguru Road aforesaid, where it crosses the division boundary of the said James Wooley and John Foster, as the same is marked upon a plan numbered 1000, now lying in the Waste Land’s Office, which road, 100 links in width, is bounded on the West by the said James Wooley’s property, 2200 links, and on the East by the said James Wooley’s property 2100 links or thereabouts.

Road, being 10½ links in width, will be bounded on the North by the said William Bedlington’s property 280 links, by the said George Burnett’s property 140 and 530 links, and by the said William Mair’s property 440, 1145, 910, 360, 330, 480, and 580 links, and on the South by the said William Mair’s property 600, 522, 839, 321, 364, 880, 1,150, 398, and 200 links, by the said George Burnett’s property 338 links, and by the said William Bedlington’s property 560 links or thereabouts.

SCHEDULE B.

A Road commencing on the Road from Wangaririe to Ngunguru at a point within the boundary of a parcel of land being a subdivision of lot 2 of the Parish Wangaririe County of Marsden, and known as James Wooley’s property 700 links or thereabouts from a stream forming the southern boundary of the said James Wooley’s property, and proceeding thence in a northerly direction through the said James Wooley’s property and terminating on the Ngunguru Road aforesaid, where it crosses the division boundary between the said James Wooley and John Foster, as the same is marked upon a plan numbered 1000, now lying in the Waste Land’s Office, which road, 100 links in width, will be bounded on the West by James Wooley’s property 40, 110, 344, 272, 242, 230, 160, 170, 284, 407, 416, 270, 369 and 320 links, and on the East by the said James Wooley’s property, 60, 165, 375, 255, 195, 115, 90, 143, 301, 416, 281, 384, and 353 links or thereabouts.
