✨ Wharf Regulations and Land Proclamation
[TON BUILDER’S MEASUREMENT]
For every day the said vessel shall so occupy the said berth.
-
The following charges shall be made for the use of the said Wharf:—
d.
For every cart or other vehicle drawn by one horse, the sum of.............. 6
And an additional sum for each additional horse, of.................... 6
For every barrow or truck the sum of 3
For every horse not drawing any cart or other vehicle, the sum of... 6
For every head of great cattle, the sum of............................. 3
For every sheep or goat, the sum of 1
For every pig, the sum of.............. 1 -
Every carter taking a cart on the said Wharf shall walk at the head of the shaft horse whilst on the said Wharf; and no carter shall allow his horse to move along the said Wharf at a pace faster than a walk, under a penalty for every such offence, not exceeding £20.

All charges payable under these Regulations shall be payable to such person as the Superintendent shall appoint to receive the same and may be recovered in a summary way, when payable by or on account of any vessel, from the master or person in charge or from the owner or agent of such vessel, and all charges payable on account of any vehicle or animal may be recovered in a summary way from the owner or person in charge.

If any fire shall be ignited or allowed to burn on board any vessel lying alongside the said Wharf, between the hours of 9 p.m. and of 5 a.m., the master of such vessel shall be liable to forfeit and pay a penalty not exceeding £20.

If any person without permission from the Wharfinger shall permit any goods to remain on the said Wharf more than 24 hours, or if any person shall remove any goods from off the said Wharf, except by permission of the Collector of H. M. Customs, between sunset and sunrise he shall be liable for every such offence to forfeit and pay a penalty not exceeding £20.

If the master or person in charge of any vessel lying alongside the said Wharf shall permit the same to be fumigated or smoked for the extermination of vermin or for any other purpose he shall be liable to forfeit and pay a penalty not exceeding £20.

Every penalty incurred for any breach of these regulations shall be recovered in a summary way.

Nothing herein contained shall be construed in any manner altering or in affecting the Regulations now in force for the Port and Harbour of Auckland.

PROCLAMATION.
By His Excellency Colonel Thomas Gore Browne, Companion of the Most Honorable Order of the Bath, Governor and Commander-in-Chief in and over Her Majesty’s Colony of New Zealand, and Vice-Admiral of the same, &c., &c.,
WHEREAS the Land hereinafter mentioned has been acquired by purchase from the aboriginal inhabitants of New Zealand, and it is expedient that the acquisition thereof should be notified by Proclamation accordingly:
Now, therefore, I, the Governor, do hereby proclaim and notify that the Native Title has been extinguished over the Block of Land whereof the boundaries are mentioned or described in the Schedule hereunto annexed.
Given under my hand, and issued under the Public Seal of the Colony, at Government House, at Auckland, this fifth day of August, in the year of our Lord, one thousand eight hundred and fifty-nine.
