After that date it does not appear whether the documents belonging to the late City Council, or the expenditure was duly authorised or not.
The salary paid to the Chairman amounts altogether to £276 15s. 2d. The salary provided for that officer by the Auckland City Council Amendment Act, for the period subsequent to the date of the passing of that Act, amounts to £45 16s. 8d.; but there is no provision or authority for the amount paid for the period prior to the passing of the Act alluded to; nor do the Minutes of the proceedings of the City Council contain any notice of the Chairman having brought before the Council a claim for salary. The sum of £230 18s. 6d., paid on account of the period prior to the passing of the Act, should therefore be recovered, as moneys issued from the City funds without authority and contrary to the resolution of the Council of the 27th of March, 1854, which requires that no money shall be paid by the Treasurer out of any funds in his hands belonging to the City, until such moneys shall have been voted by the Council, and ordered to be paid.
Several sums amounting altogether to £918 14s. were advanced to Mr. John Makepiece on account of City Works. It is not shown in the accounts that the works for which the moneys were advanced were duly executed.
Several of the payments are unsupported by vouchers. A mark (*) has been placed opposite them; they are mostly for small amounts. It will be seen from the Minutes of proceedings of an extraordinary meeting of the Council on the 30th of September 1854, that the Treasurer (Surveyor) had prepared a "Balance Sheet and Cash Account" up to that date. Mr. Allan O’Neill states, that the account alluded to, was supported by a Pocket Ledger, which was laid on the table for the information of the City Councillors, after the account had been audited. If the Account and the Pocket Ledger could be produced, it is probable that the payments unsupported by vouchers or explanations, would be found unobjectionable.

[MEMORANDUM.]
With reference to the concluding paragraph of the Auditor General’s Report on the Accounts of the late City Council, the undersigned has the honor to state that Mr. Porter, the late Provincial Treasurer (who received the documents belonging to the late City Council, or the repeal of the Act under which that body was constituted) informed him that no such documents as the Balance Sheet and Pocket Ledger, referred to, were among those received by him from the Clerk and Treasurer of the late City Council.
The Undersigned applied in March last to the late Treasurer and Clerk of the late City Council for any documents belonging to that body that might be in their possession, when they both stated that they had none. There is no reason to suppose that any such documents were ever handed over to the Provincial Government.
