78 PROVINCE OF WESTLAND GAZETTE.

The Executive Council of the Colony, delegate unto me, James Alexander Bonar, Superintendent of the Province of Westland, all the powers vested in the Governor under or by virtue of “The Gold Fields Act, 1866,” except the powers conferred by Sections twenty-two, forty, forty-eight, sixty, ninety-six, and one hundred and seven of the said Act, to have, hold, and exercise the said powers hereby delegated to me within the Province of Westland:

And whereas it is expedient that the under-mentioned person should be allowed to collect such tolls and occupy the site of the ferry mentioned in the Schedule hereto annexed for the period set opposite to his respective name:

Now therefore, I, James Alexander Bonar, Superintendent of the Province of Westland, in exercise of the powers in that behalf vested in and delegated to me, do hereby notify that I have appointed the under-mentioned person to be a toll-collector at the ferry set opposite his name, on the terms as stated below, and subject to the conditions as published in the Provincial Gazette, No. 13, of the 29th April, 1874, and do hereby authorise the collection of the under-mentioned tolls at the above named ferry.

WILLIAM WHITTEN’S PUNT,
TEREMAKAU.

  1. Protection to be for five years.

  2. SCHEDULE OF TOLLS.

Double the above charges may be made between the hours of ten o’clock p.m. and six o’clock a.m.

  1. The Government to have the right to revise the scale of tolls yearly.

  2. Persons and vehicles carrying Her Majesty’s mails, and Government officers on duty, free.

  3. Should the Government think fit to construct a bridge across the Teremakau during the term of protection, the sum of Two Hundred and Fifty Pounds sterling to be paid to the lessee by the Government, on the payment of which the punt and plant shall become the property of the Government.

  4. The punt, gear, and approaches, to be maintained in good and serviceable condition, to the satisfaction of the Provincial Engineer, and a safe and serviceable boat to be attached to the punt at all times.

  5. All timber within the limits of half a mile on either side of the punt, and within one chain from the river’s edge, to be left standing.

  6. A light to be kept burning at each side of the ferry from sunset to sunrise.

  7. The Lessee’s house to be placed as near the river as possible, having due regard to safety from floods.

  8. If the river is at any time fordable, the Lessee must give every assistance, if required to do so, in pointing out the fords to persons crossing, and in such cases the Lessee will be entitled to charge according to the above scale of charges.

  9. The Lessee to be at all times in attendance at the ferry in person: but should circumstances necessitate his temporary absence, competent persons to be provided to take charge of the ferry during such absence.

  10. Seven days in each year to be allowed to the Lessee for necessary repairs to the punt, and before the punt is withdrawn for this purpose, permission in writing must be obtained from the Government, and proper and sufficient boats must be provided for keeping the ferry open for traffic during such repairs.

  11. Protection may be cancelled should the ferry be neglected.
