Reserves at Greymouth vested in Corporation for Public Purposes.

ORDER IN COUNCIL.
At the Government House, at Wellington, this fourteenth day of May, 1873.
Present:
His Excellency the Administrator of the Government in Council.
WHEREAS by "The Westland Waste Lands Act, 1870," it is among other things enacted that the Governor in Council may from time to time, by Order in Council, direct that reserves under the said Act shall vest in and be held by any Corporation, Commissioners, or other person or persons having corporate succession, to be named in the Order, in trust for the like or other public purposes to be specified and declared in such Order, in such manner, and with such powers of leasing for any term not exceeding twenty-one years from the date of the lease, and of management of such reserves, and of disposing of the rents, issues, profits, and proceeds thereof, and other powers, provisions, and provisoes as shall be expressed and declared in such Order: And whereas the several parcels of land described in the Schedule hereto have been reserved and set apart for the purposes therein mentioned, and such reserves are now subject to the provisions of the said Act: And whereas it is expedient that the said reserves should be vested in the Mayor, Councillors, and Burgesses of the Borough of Greymouth (hereinafter called the "Corporation"), in the manner hereinafter mentioned.
Now, therefore, His Excellency the Administrator of the Government, with the advice and consent of the Executive Council, and in exercise and pursuance of all power and authority in this behalf in him vested, doth hereby order and direct that from and after the date hereof the reserves particularly mentioned and described in the Schedule hereto shall vest in and be held by the Corporation in trust for the public service of the said Borough, with power to dispose of and manage such reserves under and subject to the following conditions, that is to say:—

The said reserves shall be vested in the Corporation for the several purposes mentioned in the Schedule, and in cases where the purpose for which such reserve was made shall be specified, the Corporation shall have no power to alter the same, but such reserve shall be held in trust for the particular purpose specified.

As to the reserves mentioned in the First Part of the said Schedule, the Corporation shall have power to lease the same, or any of them, to any person or persons, or to any body corporate, for any term not exceeding twenty-one years from the date of such lease, reserving such rent or rents as the Corporation may think fit; and every such lease shall contain all usual and proper covenants on the part of the lessee or lessees, and shall contain a condition or right of re-entry for breach of any of the provisions of such lease.

As to the reserves mentioned in the Second Part of the said Schedule, before any lease or disposition thereof shall be made to any person or body corporate, the consent of the Governor shall be obtained prior to the execution of the lease, and such consent if given, shall be endorsed on the intended lease.
